ABSTRACT
En la sociedad socialista, la dirección no solo supera su carácter explotador en otros contextos, sino que da paso al franco predominio de los elementos conscientes sobre los espontáneos, es decir, que el sujeto de dirección ejerce sus efectos sobre la sociedad y sus diferentes eslabones, basado en las leyes objetivas de su desarrollo, conocidas científicamente y en situaciones concretas.
In the socialist society the administration not only goes beyond its exploitative character in other contexts, but also leads to the clear predominance of conscious elements over spontaneous ones, that is, the administration subject exerts its effects on the society and its different links based on the objective development laws well-known scientifically and in concrete situations.

Se analizó el impacto de la formación de másteres en Atención Primaria de Salud en la provincia de Santiago de Cuba luego de 12 años de iniciado ese proceso de perfeccionamiento en la educación de posgrado, tomando en cuenta la aplicación de nuevos conocimientos e instrumentos sobre buenas prácticas para incrementar la efectividad de la atención sanitaria en las áreas de salud. También se valoraron las fortalezas y debilidades en la docencia y el desempeño profesional para poder desarrollar acciones que permitan elevar la calidad de las actuaciones en ambas esferas.
The impact of master training was analyzed in Primary Health care in Santiago de Cuba province after 12 years of the beginning of this improvement process in the postdegree education, taking into account the application of new knowledge and instruments on good practices to increase the effectiveness of the sanitary care in the health areas. The strengths and weaknesses were also evaluated in teaching and professional performance in order to develop actions that allow the increase of performances quality in both spheres.

El derecho es el elemento regulador de las relaciones sociales, entre las cuales figuran las generadas en el sector de la salud, tanto en las funciones de rehabilitación como preventivas, de promoción de salud e inspección sanitaria estatal; por ello la actuación médica, independientemente de su naturaleza, tipo, clase o forma constituye un acto médico, que puede ser correcto o lícito cuando se ejecuta según las disposiciones legales u oficiales vigentes e incorrecto o ilícito cuando no las cumple durante el ejercicio de su profesión. En este artículo se tratan, entre otros importantes aspectos, los relacionados con la Teoría general del derecho médico, el sistema jurídico cubano, la Constitución cubana y el derecho a la salud, el consentimiento informado y la norma jurídica del secreto médico.
Right is the regulator element of social relations, among which there are those taking place in the health sector, either in the rehabilitation functions or preventive functions, health promotion and state sanitary supervision functions; that is why the medical role, independently of its nature, type, class or form constitutes a medical performance that can be correct or licit when it is carried out according to the present legal or official arrangements and can be incorrect or illicit when they are not fulfil during the practice of their profession. This article deals, among other important aspects, with those related to the General theory of the medical right, the Cuban legal system, the Cuban Constitution and the right to health, the informed consent and the legal regulation of the medical secret.
