ABSTRACT
A migração internacional tem merecido destaque, na atualidade, como expressão de barbárie. Este trabalho apresenta uma das particularidades desse problema macrossocietário, problematizando a negação de direitos socioassistenciais para transfronteiriços indocumentados, oriundos de cidades gêmeas do Uruguai e da Argentina, os quais não podem acessar a proteção social prevista na Política Nacional de Assistência Social (PNAS) pela ausência de nacionalidade brasileira ou de comprovante de residência no Brasil. Questiona-se o limite geográfico como determinante para a negação do acesso a serviços e benefícios socioassistenciais e aponta-se para a importância da criação de acordos entre países limítrofes, que permitam a prestação desses serviços aos transfronteiriços indocumentados, em situação de risco e vulnerabilidade social, considerando que, na PNAS, a concepção de cidadania está atrelada ao Estado-nação.
Nowadays, migrations have been in evidence as an expression of barbarianism. This paper presents one of the particularities of this macro social issue, with focus on the denial of social assistance rights to undocumented transboundary people coming from twin towns of Uruguay and Argentina, which cannot access the social protection foreseen in the National Policy of Social Assistance due either to the absence of Brazilian nationality or the attestation of living in Brazil. It also questions the geographical frontier as the determinant criterion to hinder access to social assistance services and benefits. Finally, it aims to the need of creating agreements between frontier countries that permit the provision of such services to the undocumented transboundary people in risk and social vulnerability situation, whereas there is no surpassing of the citizenship conception connected to the nation-state.
