A judicialização da saúde e a atuação do Conselho Nacional de Justiça em tempos de covid-19 / The judicialization of health and the actions of the National Council of Justice in times of covid-19

O presente artigo teve como objetivo identificar a atuação do Conselho Nacional de Justiça no que tange à judicialização da saúde, assim como seu enfrentamento aos colapsos gerados a partir da pandemia de covid-19. Seguindo esse ideário, o problema de pesquisa foi identificar os desafios e as ações estratégicas do Conselho Nacional de Justiça diante da judicialização da saúde em tempos de covid-19. A pesquisa foi desenvolvida por meio de um estudo bibliográfico, seguindo o método hipotético-dedutivo. Como resultado, observou-se que o Conselho Nacional de Justiça vem apresentando diversas ações, culminando no avanço do diálogo interinstitucional para melhorias nos serviços prestados aos cidadãos brasileiros pelo Sistema Único de Saúde. Por fim, concluiu-se que o sistema de saúde vem enfrentando há muitos anos diversas dificuldades, e a chegada dessa pandemia, que se alastrou por todo o território nacional e, consequentemente, disseminou o caos sanitário e humanitário, agravou a situação, tornando mais nítida a ausência de estrutura e de políticas públicas capazes de reduzir os abismos e discrepâncias no setor da saúde.

This article aimed to identify the actions of the National Council of Justice regarding the judicialization of health, as well as its confrontation with the collapses generated from the covid-19 pandemic. Following this ideology, the research problem was to identify the challenges and strategic actions of the National Council of Justice in the face of the judicialization of health in times of covid-19. The research was developed through a bibliographical study, following the hypothetical-deductive method. As a result, it was observed that the National Council of Justice has been presenting several actions, culminating in the advancement of inter-institutional dialogue for improvements in the services provided to Brazilian citizens by the Unified Health System. Finally, it was concluded that the health system has been facing several difficulties for many years, and the arrival of this pandemic, which spread throughout the national territory and, consequently, spread sanitary and humanitarian chaos, aggravated the situation, making clearer the lack of structure and public policies capable of reducing the abysses and discrepancies in the health sector.

A saúde pública enquanto dever do estado: o repasse deste dever à saúde suplementar / Public health as the State's duty: the handing over of this duty to supplementary health

A presente análise jurisprudencial busca fomentar a discussão acerca do dever do Estado de prestar saúde pública, apresentado na Constituição Federal de 1988, frente à saúde suplementar. Nessa perspectiva, vislumbram-se o surgimento da saúde suplementar e os deveres vinculados aos contratos antigos e aos firmados após sua regulamentação. Este debate, portanto, é norteado pelo método dedutivo a partir de uma abordagem bibliográfica. Restou analisada a transferência de responsabilidade por meio do procedimento administrativo denominado de "Ressarcimento ao Sistema Único de Saúde". Nesse cenário, apontam-se algumas considerações quanto à temática com base na jurisprudência do Tribunal do Estado do Rio Grande do Sul, do Superior Tribunal de Justiça e Supremo Tribunal Federal.(AU)

This jurisprudential analysis seeks to foster a discussion about the State's duty to provide public health, presented in the 1988 Federal Constitution, confronting supplementary health. In this perspective, are glimpsed the advent of supplementary health and the obligations linked to the old contracts and the contracts signed after its regulation. Therefore, this debate is guided by a deductive method, from a bibliographical approach. The transfer of responsibility was analyzed through an administrative procedure called Reimbursement to SUS. In this scenario, some considerations on the subject are pointed out based on the jurisprudence of the Court of Justice of the State of Rio Grande do Sul, Brazilian Superior Court of Justice and Brazilian Supreme Court.. A presente pesquisa busca analisar, e rediscutir, sob a perspectiva dos direitos humanos, a promoção e proteção da cidadania das pessoas idosas. A partir do novo cenário social, de uma sociedade que está envelhecendo, o texto tem como objetivo fomentar a reflexão acerca da conjuntura atual da velhice, verificando-se, através de uma revisão teórica as possibilidades de exercício da cidadania por meio dos direitos e garantias fundamentais, que sigam em consonância com os direitos humanos.

This research seeks to analyze and rediscuss, from the perspective of human rights, the promotion and protection of the citizenship of the elderly. From the new social scene of a society that is aging, the text aims to foster reflection on the current conjuncture of old age, verifying, through a theoretical revision, the possibilities of exercising citizenship through the rights and guarantees which are consistent with human rights.

La presente investigación busca analizar, y rediscutir, bajo la perspectiva de los derechos humanos, la promoción y protección de la ciudadanía de las personas mayores. A partir del nuevo escenario social, de una sociedad que está envejeciendo, el texto tiene como objetivo fomentar la reflexión acerca de la coyuntura actual de la vejez, verificándose, a través de una revisión teórica las posibilidades de ejercicio de la ciudadanía por medio de los derechos y garantías Fundamentales que sigan en consonancia con los derechos humanos.
