ABSTRACT Objective: To analyze if milk and complementary foods are being sold under the Brazilian Code of Marketing of Infant and Toddler's Food, Teats, Pacifiers and Baby Bottles (NBCAL), Law 11265/2006 of breastfeeding protection. Methods: Epidemiological survey that analyzed the marketing practices of pharmacies, supermarkets, and department stores in the Southern region of the city of Rio de Janeiro, Brazil, by direct observation. Results: Among the 349 stores in Rio de Janeiro's South Region, 339 traded milk and complementary foods and, among them, 60.8% were not complying with NBCAL. Infractions to NBCAL were more common for the selling of milk (58.6%) than complementary foods (22.8%). The most recurrent promotion strategy infringing NBCAL was discount pricing without the Ministry of Health disclaimer. Conclusions: Most retail stores infringe NBCAL in the commercialization of milk and complementary foods in the city of Rio de Janeiro, Brazil, a violation of the right to information that may impact mothers' choice regarding their child's feeding.


RESUMO Objetivo: Analisar se leites e alimentos de transição estão sendo comercializados de acordo com a Norma Brasileira de Comercialização de Alimentos para Lactentes e Crianças de Primeira Infância, Mamadeiras, Bicos e Chupetas (NBCAL), Lei n. 11.265/2006, de proteção ao aleitamento materno. Métodos: Inquérito epidemiológico que analisou as práticas de promoção comercial de leites e alimentos de transição em um censo de farmácias, supermercados e lojas de departamento da Zona Sul da cidade do Rio de Janeiro, por meio de observação direta. Resultados: Dos 349 estabelecimentos da Zona Sul, 339 comercializavam leites e alimentos de transição e, destes, 60,8% faziam promoção comercial em desacordo com a NBCAL. Mais da metade dos estabelecimentos (58,6%) tinha leites e 22,8%, alimentos de transição vendidos em inconformidade com a NBCAL. A estratégia de promoção comercial mais praticada foi o desconto no preço sem a frase informativa preconizada pelo Ministério da Saúde. Conclusões: A maior parte dos estabelecimentos comerciais infringe a NBCAL na comercialização de leites e alimentos de transição, configurando uma violação ao direito à informação que pode impactar na escolha das mães quanto à alimentação de seus filhos.

Resumen Introducción: la publicidad televisiva es una estrategia utilizada por la industria farmacéutica para ofrecer sus productos. En el caso de los medicamentos de venta libre, se tiene la responsabilidad de ajustarse a la normativa relacionada con estos productos, con el propósito de proteger al televidente de influencias negativas por posible publicidad imprecisa o engañosa. Objetivo: evaluar el cumplimiento normativo de la publicidad televisiva de medicamentos de venta libre en Colombia de agosto de 2018 en los canales nacionales Caracol y RCN. Metodología: se revisaron las grabaciones de anuncios publicitarios de medicamentos en los canales Caracol y RCN. Aleatoriamente, se seleccionaron los días 2, 4, 22 y 26 de agosto de 2018. La revisión de las grabaciones se realizó por dos evaluadores independientes. Los datos de los anuncios publicitarios se analizaron con estadística descriptiva. Resultados: se identificaron 624 anuncios publicitarios relacionados con medicamentos de venta libre: 601 pautas (96,3 %) y 23 comerciales (3,7 %). Entre los 624 anuncios emitidos, 226 (36,2 %) de 18 medicamentos no cumplieron con algunas condiciones establecidas en la normatividad. Discusión: este estudio, comparado con la publicación del 2014, mostró un incremento en la cantidad de anuncios que no cumplen con la norma, pasando de 8 % a 36,2 %. La principal situación de incumplimiento se debe al tamaño de la fuente, que puede limitar la lectura en poblaciones especiales. Conclusiones: los anuncios televisivos emitidos en los canales nacionales Caracol y RCN, en un 36,2 %, no cumplen con los requisitos definidos por la normatividad vigente.


Abstract Introduction: Advertising broadcast by mass media is a strategy used by the pharmaceutical sectors to offer their products. For of over-the-counter drugs, this sector is responsible for complying with the regulations related to these products, in order to protect the viewers from negative influences, for possible inaccurate or misleading advertising. Objective: To evaluate regulatory compliance in television advertising of over-the-counter drugs in Colombia in August 2018 on Caracol and RCN national channels. Methods: The recordings of the drug advertisements of two national television channels Caracol and RCN were reviewed. The days 2, 4, 22, 26 of august 2018 were randomly selected. Two independent evaluators reviewed the recordings. The data from the advertisements was analyzed with descriptive statistics. Results: A total of 624 commercials related to over-the-counter drugs were identified: 601 guidelines (96.3%) and 23 commercials (3.7%). Among the 624 advertisements broadcast by both national channels, 226 (36.2%) of 18 drugs did not meet some of the conditions established in the regulations. Discussion: Compared to the work done in 2014, shows that there was an increase in the number of advertisements that do not comply with the norm (from 8% to 36.2%). The main non-compliance situation presented by advertisements is related to the source size since small letters can limit the reading of special populations. Conclusion: 36.2% of the television advertisements broadcast on the national television channels Caracol and RCN do not meet the requirements defined by current regulations.

ABSTRACT

O objetivo deste estudo foi analisar as irregularidades da publicidade de medicamentos isentos de prescrição veiculada em mídia televisiva aberta. Trata-se de um estudo descritivo transversal, no qual duas emissoras da televisão aberta do Rio de Janeiro foram monitoradas durante sete meses. As 90 peças publicitárias coletadas foram transcritas e, posteriormente, analisadas frente à legislação vigente. Todas apresentavam alguma infração, com média de 3,6 infrações por peça. Os grupos farmacológicos mais frequentes foram os analgésicos, anti-inflamatórios, antigripais e antiácidos. Como observado por outros autores, os resultados evidenciam a deficiência no cumprimento da regulamentação e a fragilidade da fiscalização acerca da publicidade de medicamentos isentos de prescrição no Brasil, apontando para a necessidade de mudanças que priorizem a promoção do uso racional de medicamentos.


The objective of this study was to analyze the advertising irregularities of over-the-counter medicines in open television media. This is a descriptive cross-sectional study, in which two open television stations in Rio de Janeiro were monitored for seven months. The 90 pieces of advertising collected were transcribed and, later, analyzed under the current legislation. All had some infraction, with an average of 3.6 infractions per piece. The most frequent pharmacological groups were analgesics, anti-inflammatories, antiflu and antacids. As observed by other authors, the results show the deficiency in the compliance with the regulations and the fragility of the supervision regarding the advertising of over-the-counter medicines in Brazil, pointing to the need for changes that prioritize the promotion of rational use of medicines

ABSTRACT

ABSTRACT OBJECTIVE To assess if the commercialization of infant formulas, baby bottles, bottle nipples, pacifiers and nipple protectors is performed in compliance with the Norma Brasileira de Comercialização de Alimentos para Lactentes e Crianças de Primeira Infância e de Produtos de Puericultura Correlatos (NBCAL - Brazilian Code of Marketing of Infant and Toddlers Food and Childcare-related products). The commercial promotion of these products is prohibited by the Law 11,265. METHOD Cross-sectional study conducted in 2017 through a census of all pharmacies, supermarkets and department stores that sold products covered by NBCAL in the South Zone of Rio de Janeiro. Health professionals trained at NBCAL used structured electronic form for direct observation of establishments and for interviews with their managers. We created indicators to evaluate commercial practices and performed descriptive analyses. RESULTS A total of 352 commercial establishments were evaluated: 240 pharmacies, 88 supermarkets and 24 department stores, of which 88% sold products whose promotion is prohibited by NBCAL. Illegal commercial promotions were found in 20.3% of the establishments that sold the products we investigated: 52 pharmacies (21.9%), four supermarkets (7.5%) and seven department stores (33.3%). The most frequent commercial promotion strategies were discounts (13.2%) and special exposures (9.3%). The products with the highest prevalence of infractions of NBCAL were infant formulas (16.0%). We interviewed 309 managers of commercial establishments; 50.8% reported unfamiliarity with the law. More than three-quarters of the managers reported having been visited at the establishments by commercial representatives of companies that produce infant formulas. CONCLUSION More than a fifth of commercial establishments promoted infant formulas, baby bottles and nipples, although this practice has been banned in Brazil for thirty years. We think it is necessary to train those managers. Government agencies must monitor commercial establishments in order to inhibit strategies of persuasion and induction to sales of these products, ensuring mothers' autonomy in the decision on the feeding of their children.


RESUMO OBJETIVO Avaliar se a comercialização de fórmulas infantis, mamadeiras, bicos, chupetas e protetores de mamilo é realizada em cumprimento com a Norma Brasileira de Comercialização de Alimentos para Lactentes e Crianças de Primeira Infância e de Produtos de Puericultura Correlatos (NBCAL). A promoção comercial desses produtos é proibida pela Lei 11.265. MÉTODOS Estudo transversal conduzido em 2017 por meio de um censo de todas as farmácias, supermercados e lojas de departamento que comercializavam produtos abrangidos pela NBCAL na Zona Sul do Rio de Janeiro. Profissionais de saúde capacitados na NBCAL utilizaram formulário eletrônico estruturado para observação direta dos estabelecimentos e para entrevista com seus responsáveis. Foram criados seis indicadores de avaliação das práticas comerciais e realizadas análises descritivas. RESULTADOS Foram avaliados 352 estabelecimentos comerciais: 240 farmácias, 88 supermercados e 24 lojas de departamento, dos quais 88% comercializavam produtos cuja promoção é proibida pela NBCAL. Foram encontradas promoções comerciais ilegais em 20,3% daqueles que comercializavam os produtos investigados: 52 farmácias (21,9%), quatro supermercados (7,5%) e sete lojas de departamento (33,3%). As estratégias de promoção comercial mais frequentes foram os descontos (13,2%) e as exposições especiais (9,3%). Os produtos com maior prevalência de infrações à NBCAL foram as fórmulas infantis (16,0%). Foram entrevistados 309 responsáveis por estabelecimentos comerciais, 50,8% relatando não conhecer a lei. Mais de três quartos dos responsáveis relataram receber visitas nos estabelecimentos de representantes comerciais de empresas fabricantes de fórmulas infantis. CONCLUSÃO Mais de um quinto dos estabelecimentos comerciais faziam promoção comercial de fórmulas infantis para lactentes, mamadeiras e bicos, apesar de essa prática ser proibida no Brasil há trinta anos. É necessária a capacitação dos seus responsáveis. Os órgãos governamentais devem realizar fiscalização dos estabelecimentos comerciais para coibir estratégias de persuasão e indução à vendas desses produtos, garantindo às mães autonomia na decisão sobre a alimentação de seus filhos.

ABSTRACT OBJECTIVE To verify the compliance with Law No. 11,265/2006 in the promotion strategies for infant formula in Brazilian websites of manufacturers and drugstore networks. METHODS This was a cross-sectional study conducted in 2017. We analyzed the compliance to attributes of the Law No.11,265/2006 (Law for Marketing of Foods for Infants and Toddlers, Feeding Bottles, Teats and Pacifiers) in five websites of infant formula manufacturers and nine websites of drugstore networks. The main attributes assessed were: the presence of drawings or representations of children, the presence of warning statements displayed in conspicuous and prominent spaces informing if products are intended for infants aged under or over 6 months, the adequate display of infant formulas/similar products, and the presence of pop-ups with other infant formulas or links to websites for children's products. All compliances and non compliances verified were described in absolute and relative frequencies. RESULTS We verified that 80% of the websites of infant formula manufacturers displayed advertisements for other children's food products. The main non compliance in infant formula manufacturer's websites was the absence of warning statements about products intended for infants over 6 months of age. Only 33% of the drugstores' websites complied with Law No. 11,265/2006. The main non compliances in these websites were the absence of warning statements on products intended for infants over 6 months of age (100%), the presence of pop-up advertisements for other infant foods (77%) and the presence of advertisements for other children's food products (92%). CONCLUSION We identified non compliances with the Law No. 11,256/2006 in almost all websites of infant formula manufacturers and in all the websites of drugstore networks. Most promotion strategies were found at drugstore websites, which are the main channels for online sales.

ABSTRACT

The effects of marketing strategies for promotion of foods and beverages have been investigated due to its potential impacts on populations' food choices, particularly among children and adolescents. The paper presents an academic literature review on regulation and self-regulation of food and beverage advertisements in Brazil, based on search performed in electronic databases. Majority of studies were based on law analysis or qualitative study of advertisements. There are sufficient evidences on the need for government regulation of advertisements addressed to children and adolescents complementarily to institutional self-regulation in order to tackle ethical transgressions on food and beverage advertisements identified in Brazil. Additionally, there should be imposition of rigorous penalties for noncompliance to ethical rules and proposition of incentives towards actions encouraging healthy food consumption patterns, in order to comprise an actual system for promotion of public health.


Os efeitos de estratégias de marketing para promoção de alimentos e bebidas têm sido investigados devido aos potenciais impactos sobre escolhas alimentares populacionais, particularmente entre crianças e adolescentes. O artigo apresenta revisão de literatura acadêmica sobre regulação e autorregulação de propagandas de alimentos e bebidas no Brasil, baseada em busca realizada em bases de dados eletrônicas. A maioria dos estudos identificados referia-se a análise de legislação ou estudo qualitativo das propagandas. Há evidências de necessidade de regulação das propagandas direcionadas a crianças e adolescentes em complementação ao sistema de autorregulação institucional para combate às transgressões éticas identificadas em propagandas de alimentos e bebidas no Brasil. Adicionalmente, há necessidade de aplicação de penalidades severas para transgressões éticas, assim como incentivos às ações de apoio à alimentação saudável para compor um sistema efetivo de promoção da saúde pública.


Los efectos de estrategias de marketing para promoción de alimentos y bebidas se han investigado debido a los potenciales impactos sobre elecciones alimenticias poblacionales, particularmente entre niños y adolescentes. El artículo presenta una revisión de la literatura académica sobre regulación y auto-regulación de propagandas de alimentos y bebidas en Brasil, con base en una búsqueda realizada en bases de datos electrónicas. La mayoría de los estudios identificados se refería al análisis de la legislación o estudio cualitativo de las propagandas. Hay evidencias de la necesidad de regulación de las propagandas dirigidas a niños y adolescentes en complementación al sistema de auto-regulación institucional para el combate a las transgresiones éticas identificadas en propaganda de alimentos y bebidas en Brasil. Adicionalmente, hay la necesidad de aplicación de penalidades severas para transgresiones éticas, así como incentivos a las acciones de apoyo a la alimentación saludable para componer un sistema efectivo de promoción de la salud pública.

A medical advertisement can include media such as newspapers, magazines, and the Internet. Currently, the Internet is responsible for most medical advertising. Our purpose is to investigate the current status of radiologic images posted on hospitals' websites nationwide, and to evaluate the reliability of online medical advertisements using these images. I investigated the websites of all 1,450 hospitals and 290 oriental medicine clinics nationwide. Specific information on the radiologic images posted was recorded. In terms of body parts, musculoskeletal images account for 78% of the radiologic images on hospitals' websites and 98% of the images for oriental medicine clinics. The purposes for posting radiologic images are to explain the pathophysiology of diseases or the technique of surgical treatments, and to show the effects of hospital-specialized treatments. The most commonly used modalities of radiologic images are plain radiography and MR. More than 90% of the posted images have no source; 10% have no legends; and 5% to 7% have inappropriate legends. In terms of quality, only 60% of the radiologic images on hospitals' websites are rated as acceptable. Fifteen percent of the oriental medicine clinics posted the radiologic images without having a medical doctor on staff. Considering the results, I conclude that it is necessary to re-establish a system of pre-screening and post-evaluation for reviewing hospital websites, especially focusing on the radiologic images posted. Then we can prevent the inappropriate information from influencing or damaging public health, and set up healthy medical competition.

Introdução: O Brasil é o país com o maior número de cirurgiões-dentistas do mundo e, devido à má distribuição deste grande número de profissionais, existe uma grande concorrência entre eles, gerandouma necessidade para o profissional de lançar mão de ferramentas que possam ajudar na busca e manutenção de clientes. Objetivo: Avaliar duas redes sociais (Facebook® e Instagram®) de cirurgiões dentistas e clínicas odontológicas em relação aos cumprimentos dos preceitos do Código de Ética Odontológica (CEO), bem como verificar infrações éticas cometidas nestas redes sociais. Metodologia:Usou-se, para coletada de dados, um questionário composto por 14 itens baseados nas infrações éticascitadas no CEO. Consideraram-se fotografias e legendas nas redes sociais estudadas, Facebook® eInstagram®, num total de 257 páginas, sendo 187 para o Facebook® e 70 para o Instagram®, no períodode agosto a setembro de 2015. As páginas foram coletadas e analisadas pelo mesmo pesquisador. Osdados foram armazenados e analisados no programa Epi Info. Resultados: Foi constatado que 97,28%estavam em desacordo com pelo menos um dos 14 itens investigados. Conclusão: Em virtude dos dadosobservados, percebemos a necessidade de uma maior fiscalização destas redes sociais, visando umrespeito aos usuários dos serviços. Além disso, é notória a necessidade de atualização dos profissionais,credenciados a estas redes, com o Código de Ética Odontológica, uma vez que o mesmo está emconstante atualização.


Introduction: Brazil is the country with the largest number of dentists and due to the bad distribution of this large number of professionals there is a lot of competition between them. This generates a need for newtools of attracting and retaining clients. Objective: Evaluate dentists’s and dental clinics’s use of two socialnetworks (Facebook® and Instagram®) in compliance with the Brazilian Dental Code of Ethics (CEO)using a questionnaire. Materials and methods: The information was collected from pictures and titles in therespective social networks sites from a sample of 257 pages. 187 for Facebook® and 70 for Instagram®by applying a 14 itens questionnaire. The data was collected and analyzed via Epi Info. Results: It was foundthat 97.28% were irregular with at least one of the 14 surveyed items. Conclusions: Looking at thecollected data, a need of a better supervision of those social networks in order to protect customersbecomes clear. Furthermore, it is important for professionals using those networks to keep themselves upto date regarding of the Brazilian CEO and its constant changes.
