ABSTRACT

This article discusses the resonances of the debate between Butler and the psychoanalysts about sexual difference, taking Rancière's perspective on "disagreement" into account. The proposal is to undertake a history of the present, in order to highlight the context of problematizations about sexual identity, in which the truth regarding the subject is formulated. As a result of this theoretical investigation, it is emphasized that Butler evokes historical discontinuities that cause impasses in the approaches of Psychoanalysis on the World. On the side of this science, a brief literature review demonstrated the importance of the reference to the last Lacan. By subjecting the results to Rancière's perspective, Psychoanalysis is situated in a larger space of concern about the subject and the place assigned to him between science and the World. Still, Butler, through her uneasiness with the legitimation of experience, invests in expanding the intelligible barriers of the universal subject.

ABSTRACT

As one may see in the course of this paper, the author explores briefly the theme of silence in order to solve some theoretical and clinical postulates about instinctual duality - that is, life and death. His purpose is to enable a metapsychological listening at this silence. In this process, the author proposes to discard the idea that silence is exclusively a result of death drive - which, according to the author, is a misconceived idea. In order to fulfill this purpose, the author establishes a difference between death drive and destructive drive, and he also restores the relation between those drives and disagreement (or discord). Therefore, the author continues, silence is broken in the instinctual clash. In this sense, the author advocates that the most absolute silence lies in which one might call the incomplete fusion, which means the destructive drive that is precariously connected to libido, and/or the complete fusion, which means the destructive drive that is, in the other hand, excessively linked to libido. Thus, silence is a result of the lack of expressive differences between the instinctual forces. This lack implies the death and/or the no construction of desire. This lack also contributes to the psychic homeostasis (a low level of psychic entropy).

ABSTRACT

Over time, we have come to realize that some of the theories we use prevent us from discussing what is related to social subjectivity and political subject in sessions. In other words, there is always a surprising present, which does not correspond to the past we have already known. Therefore, we need to broaden our theoretical frameworks in order to approach these matters, which concern the process of belonging, our interactions in different areas, the social ethics, and are also related to taking responsibility for our own acts; in short, we have to recognize ourselves as political subjects.

ABSTRACT

The objective of this case report is to highlight some learning points behind the reasoning of the Appellate Court in a case where there were two different expert opinions by two forensic psychiatrists from two distinctive Malaysian Approved Psychiatric Hospital in regard to the soundness of mind of Mr. A for an alleged offence punishable by a death penalty. Methods: This case report is based on the reasoning of the Appellate Court in rejecting the plea of the prosecutor. Results: The High Court order remained in which the defendant was found not guilty due to reason of insanity (NGRI) provided by the Malaysian Law under Section 84 of Penal Code for the charge of dangerous drug trafficking, and he was ordered by court to undergo treatment for his underlying mental illness in a Psychiatric Institution under Section 348(1) of the Malaysian Criminal Procedure Code. Conclusion: In writing expert report, it is preferable to use a singular first-person pronoun in stating the conclusion. If there are other experts involved in either current or previous assessment, it would be beneficial to address their different opinions in the expert report. However, expert opinion is still an ‘opinion',’ and the court would be perfectly entitled to reject or differ from any of the expert opinions when there are proper grounds to do so. ABSTRACT

ABSTRACT

We investigated causes of interrater disagreements in the observational assessment of clinical training for first-year postgraduate trainees. In 1998 25 first-year postgraduates rotated through the Second Department of Surgery for 3 months, including 1 month in cardiovascular surgery, thoracic surgery, and upper-gastrointestinal surgery. Each trainee cared for several patients at most with a senior resident under the supervision of senior staff members. Nine attending physicians (staff members), 3 doctor-course graduates, and 2 chief residents assessed the trainees at the end of the rotation with special reference to clinical, social, and supervisory abilities. Trainees were given scores of “Good, ” “Fair, ” “Pass, ” or “Fail” for each ability. Interrater disagreements often involved responsibility and activeness, which reflected social abilities, and rapid patient consultations, orderly arrangement of laboratory examinations and procedures, and avoiding ordering of unnecessary laboratory examinations and medications, which reflected supervisory abilities. Assessments of poorly performing trainees often disagreed. Some interrater disagreements were seen among 4 of 14 attending physicians, but disagreements were fewer among the 3 doctor-course graduates and 2 chief residents who were graduates of the college. Both the proper training of assessors and a good relationship between assessors and rotators are necessary to make appropriate evaluations that might affect the career of postgraduates trainees.
