ABSTRACT
El fomento de un entorno seguro es una función esencial de las enfermeras, que ocupa cada vez más un lugar central en la gestión del cuidado. El propósito de este artículo es develar la existencia de una relación ético-jurídica entre la gestión del cuidado y la gestión de riesgos, en el contexto de la seguridad del paciente. Método: bajo un criterio ético-jurídico se reflexiona sobre la atención de enfermería y la seguridad del paciente. Resultados: se demuestra una vinculación de carácter ético-jurídico entre la gestión del cuidado y la gestión de riesgos. Se define a qué orden pertenece dicha vinculación y cómo se integra a la gestión del cuidado. Por último, se propone la supervisión por riesgos. Conclusiones: al demostrar la vinculación ética y jurídica existente entre la gestión del cuidado y la gestión de riesgos, la seguridad del paciente se levanta, para las enfermeras y la enfermería, como un imperativo moral y profesional.
Promoting a safe environment is an essential function of nursing and occupies an increasingly central role in care management. The purpose of this article is to show the existence of an ethical-legal relationship between care management and risk management in the context of patient safety. Method: The article reflects on nursing care and patient safety from an ethical-legal standpoint. Findings: An ethical-legal link between care management and risk management is demonstrated. The order of that relationship and how it fits in with care management are defined, and risk supervision is proposed. Conclusions: Demonstrating the ethical and legal relationship between care management and risk management enhances patient safety as a moral and professional imperative for nurses and nursing.
O fomento de um ambiente seguro é uma função essencial dos enfermeiros e ocupa cada vez mais um lugar central na gestão do cuidado. Nesse sentido, o propósito deste artigo é evidenciar a existência de uma relação ético-jurídica entre a gestão do cuidado e a gestão de riscos no contexto da segurança do paciente. Método: sob um critério ético-jurídico, reflete-se sobre o atendimento de enfermagem e a segurança do paciente. Resultados: demonstra-se uma vinculação de caráter ético-jurídico entre a gestão do cuidado e a gestão de riscos. Define-se a que ordem pertence essa vinculação e como se integra à gestão do cuidado. Por último, propõe-se a supervisão por riscos. Conclusões: ao demonstrar a vinculação ética e jurídica existente entre a gestão do cuidado e a gestão de riscos, a segurança do paciente se torna, para os enfermeiros e para a enfermagem, um imperativo moral e profissional.

Influenced and Shaped by Confucian ethics as well as the philosophy of traditional Chinese medicine,the traditional Chinese physician-patient ethics thought has evolved its specific characteristics,including the physician′s attitude towards patients which prefers to treat patients as one′s own families and consider the case in patients′ shoes,the treating manner which emphasizes impartiality and politeness among all patients,the profit principle which values justice above material gains,the self-discipline consciousness of being decent and fair,and meanwhile emphasizing patients′ share of responsibility in the disease treating process.All those are precious treasures in the traditional Chinese physician-patient ethics thought,and worth further exploration.
