ABSTRACT

Restrictions (burdens) of land plots are the subject of land and legal relations, which are fixed by legal documents (for example, a lease agreement, a contract for free fixed-term use, an agreement on the limited use of a land plot, etc.). Moreover, restrictions (burdens) can be part of the subject of land and legal relations (areas under buildings, structures, engineering communications, etc., which are part of land plots with registered rights). Questions of theory, practice and methodology are represented in some works on history, the theory of civil law, and especially those relating only servitudes reflected in many studies. It should be noted that the documented information of the Real Estate Cadastre is constantly updated in accordance with the changed legal status of land plots and land use subjects taking into account the transactions made, the presence of the agricultural production condition of the land, as well as environmental and other restrictions, including servitudes, etc. All this information that changes over time should be open and accessible to the participants in land relations. The state registration of rights to land and other immovable property and transactions is a legal act of recognition and confirmation by the state of the existence, occurrence, restriction (burdens), transfer or termination of rights. The right to a land plot arises as a result of the state registration; it is reflected in the land cadastre. The state registration is the only evidence of the existence of a registered right; the right to land and other real property can only be contested in the courts. In view of the above, it can be assumed that the theme of the work is relevant and has great scientific and practical importance.

ABSTRACT

Land is extremely valuable in the activities of any society. As the main component of the environment, land performs an important ecological function. The land surface serves as the location for various objects, and its soil layer is used as a means of production in agriculture and forestry. Essentially, land is the main and natural factor in any sphere of business, directly or indirectly involved in the production of all other goods and amenities. The social role of land is that it serves as a habitat and a condition for human life. Finally, the land as a territory of a state or its administrative-territorial units determines a political function. Land legislation and adopted regulatory acts of the Russian Federation and subjects of the Russian Federation govern land relations, rights and obligations of subjects of land relations, the basic rules for the functional use of land resources in various sectors, establish differences in the legal regime of land and determine the procedure for solving a whole number of other issues. The topic of this work is relevant due to the fact that the registration of land relations is one of the most acute, problematic and still not completely resolved issues to date.

ABSTRACT

Currently, the oil and gas industry is one of the most important elements of the economy of the Russian Federation; its reliable operation is an important factor for further economic development of the country. Linear communication objects help to track the state of the oil and gas industry objects and manage oil and gas industry objects, so the provision of land plots for the construction of linear communication objects is of great importance for the development of the oil and gas industry as a whole. The topic is relevant due to the fact that the theoretical study of the organization of land relations, the characteristics and procedure for the provision of a land plot for a linear communication object are important issues for both land management and the State Real Estate Cadastre. The procedure for providing a land plot for the construction of linear infrastructure (a fiber-optic communication line), examined in the course of the work, includes: 1) preparatory administrative actions; 2) considering the possibility of using a land plot by the department of architecture; 3) a meeting of the land and town-planning commission and taking the decision on the possibility or impossibility of approving the location of the object; 4) issuing a decree on the preliminary approval of the location of the object; 5) publication of a legal act on the approval of the location of the land plot on the cadastral map of the relevant territory and on the approval of the act of selecting the land plot; 6) establishing the boundaries of the land plot on the site to prepare a delimitation plan; 7) state cadastral registration of a land plot; 8) issuing a decree on the lease of a land plot; concluding the contract of lease with the applicant.

ABSTRACT

A land plot is part of the earth's surface, the boundaries of which are defined in accordance with federal laws. Currently, there are two methods of providing land plots for a recreation zone: without the prior agreement of the object location and with the preliminary agreement of the object location. The paper analyzes the regulatory and legal acts of the Russian Federation governing land relations. The purpose of the work is to study the process of providing land plots. The object of the study is a land plot provided for the placement of recreational facilities. The subject of the study is the system of normative legal documents regulating land relations. In this paper, the author considers the procedure for the provision of land plots for a recreational zone with a preliminary agreement on the location of the object by the example of a land plot requested for the development of a forest park. Compliance with legal requirements and substantive rules of law is largely determined by the regulation of the process of their application, that is, the fulfillment of procedural provisions. In general, the procedure for allocation of land plots and the rights to them in the land legislation is provided in sufficient detail. Since a public authority is one of the parties in the relationship on the provision of land plots, and a land plot, that is, a specifically valuable form of real estate, is the object thereof, both provisional procedures (with the object location agreement and without it) consist of a number of stages regulated in detail by the land legislation.

ABSTRACT

The State Real Estate Cadastre of the Russian Federation and its technologic methods were substantially modified at every step of their development. This has caused the following: to date, the State Cadastral Registration contains the data for land plots, the boundaries of which have been set in accordance with the law, as well as the data for earlier recorded land plots without descriptions of boundaries and their demarcation afield. Additionally, the boundary description for registered land plots is often inconsistent with their real site location. One of the reasons is that the visual checking of site location for boundaries described by a cadastral engineer during the registration of land plots is not provided; so, it is impossible to identify the errors at once. The timeliness of this work is that a large volume of records for land plots accumulated in the Real Estate Cadastre requires adjustment and correction; and the performance of complex cadastral works which have been described in Russian legislation recently makes it possible to correct the errors and simultaneously specify the locations of all land plots within the boundaries of one or several closely-spaced cadastral units at once. The mission of the study is the development of methods for the implementation of complex cadastral works for position updating of land plot boundaries based on the data received using an unmanned aerial vehicle. To achieve this goal, the following tasks should be solved: • Articulate the concept and detect the background for the introduction of complex cadastral works in the Russian Federation. • Analyze the data of the State Real Estate Cadastre for land plots which are the targets for complex cadastral works. • Describe the technique of aerial photography using unmanned aerial vehicles and provide the assessment of the accuracy of positioning using orthophotoplans. The work reveals the procedure of complex cadastral works based on digital orthophotoplans; the technique of aerial photography using the compilation of unmanned aerial vehicles and orthophotoplans is described; the assessment of the accuracy of positioning by a digital orthophotoplan is provided. The performance of complex cadastral works will allow updating the data of the State Real Estate Cadastre and improving the efficiency of territory management. The procedure for complex cadastral works based on the data received using unmanned aerial vehicles has been developed.
