ABSTRACT

【Objective:】 To explore the ethical dilemmas faced by the critical care physicians in the process of practicing the right to informed consent in a region of Beijing. 【Methods:】 14 doctors in the critical care unit from 5 medical institutions in a certain region of Beijing were interviewed in depth face-to-face by qualitative research method. The data obtained were analyzed through coding, classification, and extraction of subjects. 【Results:】 The lack of trust in doctor-patient communication leads to the instrumentalization of the right to know. When the decision of family members is inconsistent with the patient’s right to life and health, doctors are faced with the dilemma of choice and its impact. 【Conclusions:】 Faced with such ethical dilemmas, it is suggested to rebuild doctor-patient trust through multiple measures, and make appropriate restrictions on the agent-executing of the right of informed consent.

ABSTRACT

The conflict between doctors′ special right to intervene and patients′ right of informed consent is a main cause of the current tense doctor-patient relationship with the absence of related legislation.This article gave suggestions on legislation and possible ways for solving the problems after analyzing the two rights from the angles of basic connotation,research progress of comparative law,and the underlying reason for the two rights′ conflict.

The case of LI Li-yun involves the right of life,the right of informed consent and the special right to intervene from the inspection of right.By analyzing the concepts of three kinds of rights and discussing the conflicts between the right of informed consent,the right of life,and the special right to intervene,it presents the principles of equity of right and the measures of legal insurance which are essential conditions to end this kind of tragedy.

ABSTRACT

During medical activity,there are theory and realism spring of that the right of emergency treatment is in conflict with the right of informed consent.Simply investigating responsibilities is of no avail to solve the conflicts.To Interpret the real reasons of the conflict through legal and ethical aspects.To avoid and reduce conflict,the effective measures are that perfecting the rules of relevant law,elucidating the rights and obligations of hospital and medical staff;regulating the contents of informed consent form and strengthening medical ethics education.
