ABSTRACT

O objetivo deste artigo é estudar a proteção do direito humano e social à saúde tanto na legis-lação como na jurisprudência interamericanas, a fim de estabelecer os contornos desse direito no contexto interamericano de proteção aos direitos humanos. Nesse sentido, a problemática a ser enfrentada consiste em: como o direito à saúde é protegido pelo sistema interamericano de direitos humanos e na jurisprudência da Corte Interamericana de Direitos Humanos? Para dar conta dessa tarefa, foram utilizados o método de abordagem dedutivo, o procedimento analítico e a técnica de pesquisa bibliográfica. A importância do presente estudo também está atrelada ao enfrentamento do tema da justiciabilidade dos direitos sociais, principalmente do direito à saúde, no âmbito da Corte Interamericana. Ao final, verificou-se que o direito à saúde recebe respaldo no artigo 26 da Convenção Americana de Direitos Humanos, que trata do desenvolvimento progressivo dos direitos econômicos, sociais e culturais, permitindo sua justiciabilidade. Todavia, até 2018 não havia na jurisprudência da Corte Interamericana uma garantia do direito à saúde como um direito autônomo ­ o que somente ocorreu com o caso Poblete Vilches e outros versus Chile. Até então, o direito à saúde contava com uma proteção via direitos civis e políticos, ou seja, indireta.


The purpose of this article is to study the protection of human and social rights to health, both in the Inter-American legislation and jurisprudence, in order to establish the boundaries of this right in the Inter-American context. In this regard, the problematics to be faced consists of finding out: in what ways is the right to health protected by the Inter-American human rights system and the jurisprudence of the Inter-American Court of Human Rights? In order to answer this question, the approaches used were deductive; analytical and the bibliogra-phical research technique. The importance of this study is also attached to the confrontation around the subject of justiciability of social rights, mainly, of the right to health, within the Inter-American court. By the end, it was verified that Article 26 of the American Convention on Human Rights, which deals with the progressive development of economic, social and cultural rights, upholds the right to health, allowing its justiciability. However, until 2018, there was no guarantee of the right to health as an autonomous right in the jurisprudence of the Inter-American Court ­ as occurred with the case of Poblete Vilches et al. versus Chile. So far, right to health had not a protection through political and civil rights, that is, indirectly.

ABSTRACT

No contexto dos megaeventos no Brasil, foi lançada uma campanha pelo Fundo das Nações Unidas para a Infância (UNICEF) - "Está em suas mãos proteger nossas crianças" -, com o objetivo de prevenir e denunciar casos de exploração e violência contra crianças e adolescentes. As estratégias de comunicação utilizadas nos dão pistas de como os efeitos de poder circularam nesse processo, sendo importante uma análise mais minuciosa de algumas considerações genealógicas ancoradas em algumas ferramentas de Michel Foucault. Interrogamos que as estratégias usadas articularam o marketing às práticas de judicialização da vida, caindo em um denuncismo que opera a defesa e punição e pouco a rede de garantia de direitos dessas crianças e desses adolescentes. Ao dar uma resposta mais imediata, esses serviços tornam-se uma política de emergência e uma ferramenta de luta midiatizada, baseada na denúncia, na lógica penal e no negócio do social. (AU)


In the context of mega-events in Brazil, a campaign was launched by the United Nations Fund for Children (UNICEF): It's in your hands to protect our children, aiming to prevent and report instances of exploitation and violence against children and adolescents. Communication strategies used give us clues as to how the effects of power circulated in this process, an important closer examination of some genealogical considerations anchored with some tools of Michel Foucault. Questioned that the strategies articulated the marketing practices of judicialization of life; falling into a denunciation which operates the defense and punishment and little by network ensuring the rights these children and adolescents. To give a more immediate response, these services become a political emergency and tool mediated struggle, based on the complaint, the criminal and the logic of social business. (AU)


En el contexto de los megaeventos en Brasil, se lanzó una campaña por el Fondo de las Naciones Unidas para la Infancia (UNICEF): Está en tus manos para proteger a nuestros niños, con el objetivo de prevenir y denunciar los casos de explotación y la violencia contra los niños, niñas y adolescentes. Las estrategias de comunicación utilizadas nos dan pistas sobre cómo los efectos del poder circular en este proceso, un importante examen más detallado de algunas consideraciones genealógicas anclados con algunas herramientas de Michel Foucault. Cuestionaron que las estrategias articulan las prácticas de comercialización de la judicialización de la vida, cayendo en una denuncia que opera la defensa y castigo y poco a la red para garantizar los derechos de estos niños y adolescentes. Para dar una respuesta más inmediata, estos servicios se convierten en una emergencia política y herramienta mediada lucha, basado en la denuncia, la penal y la lógica de negocio social. (AU)

ABSTRACT

Due to the deep-rooted structural problems of political and sanitary structures ,most methods and meas-ures of cure for public hospital are low efficient or none effective .Analysed the hospital background such as institu-tion,marketing and culture ,we should hold the tendency that hospital reforming didn't fit in with our country's situa-tion,it is important that the reforming become more systemcial and harmonized .Therefore ,we have to strengthen the governmental responsibility of public sanitation ,introduce a competitive mechanism ,promote the reform of property right, Drawing lessons and experiences from state-owned enterprise reform , we should explore a kind of standard modern management system which is suitable to non-profit hospitals in China .

ABSTRACT

Intellectual property rights system and its safeguard mechanism are critical and fundamental for intellectual property rights of hospitals, yet few academic studies have been made in this regard. The author defined the content of various intellectual property rights of hospitals, along with discussions and summary for the inner structure of such intellectual property rights. Based on objective analysis of the vulnerabilities causing loss of intellectual property rights of hospitals in China, the author came up with three mechanisms for loss prevention, remedy and development. These recommendations are designed to build a relatively complete intellectual property rights system and the safeguard mechanism for hospitals.

ABSTRACT

Community participation in the rural healthcare service is still necessary under existing Chinese social conditions to achieve the goal of providing general rural public with safe,effective,convenient and inexpensive medical and healthcare services,as is declared in the 17th national people's committee report.The property rights system reform in rural healthcare centers is a reflection of community participation,and related problems in its participation process should be handled by steering the rudder of fairness when the Government applies its functions.The ultimate goal of rural healthcare property rights reform is to achieve the healthcare fairness for every rural individual,and thus right of each participator and fairness in the reform should be ensured.
