ABSTRACT

O objetivo deste estudo é apresentar as medidas adotadas para a garantia da autonomia e da voluntariedade de participantes em uma pesquisa conduzida com adolescentes em medida socioeducativa de internação. As medidas relatadas foram embasadas na resolução nº 510/2016 do Conselho Nacional de Saúde e se referem: à garantia de um local de coleta de dados sem interferência dos agentes socioeducativos; ao emprego de vocabulário acessível aos participantes; ao estabelecimento de compromisso entre pesquisadores e participantes sobre o sigilo das informações; e à realização de diferentes modalidades de encontros individuais entre pesquisadores e participantes. Garantir a autonomia e a voluntariedade dos adolescentes em medida socioeducativa demanda a tomada de medidas inovadoras que, ainda que fundamentadas nas resoluções éticas em vigor, devem ir além destas.


This study presents measures adopted to guarantee autonomy and voluntariness of participants in a research conducted with adolescents under social-educative measure of confinement. The measures reported were based on Resolution 510/2016, from the National Health Council, and refer to: guaranteeing a place for collecting data without interference from social-educative agents; use of vocabulary accessible to participants; establishment of a compromise between researchers and participants about the confidentiality of information; and the realization of different modalities of individual meetings between researchers and participants. Guaranteeing the autonomy and voluntariness of adolescents under a social-educative measure demands the adoption of innovative measures that, although based on the ethical resolutions in force, must go beyond these.


El objetivo de este estudio es presentar las medidas adoptadas para la garantía de la autonomía y de la voluntariedad de participantes en una investigación conducida con adolescentes en medida socioeducativa de internación. Las medidas relatadas se basaron en la resolución 510/2016 del Consejo Nacional de Salud y se refieren a: la garantía de un lugar de recolección de datos sin interferencia de los agentes socioeducativos; el empleo de vocabulario accesible a los participantes; el establecimiento de compromiso entre investigadores y participantes sobre la confidencialidad de las informaciones; y la realización de diferentes modalidades de encuentros individuales entre investigadores y participantes. Garantizar la autonomía y la voluntariedad de los adolescentes en medida socioeducativa demanda la toma de medidas innovadoras que, aunque fundamentadas en las resoluciones éticas en vigor, deben ir más allá de éstas.

ABSTRACT

Informed consent is the procedure that respects the autonomy of patients ; doctors protect patients' choices and rights through informed consent. Competence and voluntariness are prerequisite for the informed consent. In recent years, the necessity of informed consent from the Psychiatric department has been raised. Regarding informed consent from the Psychiatric department, there is a need to consider from two perspectives : respect for the patient's decision-making ability and the psychiatrist's legal self-protection. In competence and voluntariness, psychiatric patients were excluded due to lack of decision-making ability and willingness. However, not all psychiatric patients were able to perform the given task. Therefore, informed consent is needed in the point of view regarding the decision-making ability of psychiatric patients. Psychotropic medications, particularly antipsychotics, can cause several side effects, including extrapyramidal syndrome and metabolic syndrome. Therefore, preannouncement of these patients for these side effects is needed. However, when the informed consent is only applied to psychiatric hospitals, it may increase prejudices and misconceptions about psychiatric medications and treatment. Therefore, the informed consent should first be considered carefully and thoughtfully.

ABSTRACT

The effective implement of informed consent depends on the adequate disclosure of the medical information, the understanding and the voluntariness of the patients, the competency and the effective decision of the patients. The process of informed consent is the progress of the composing elements. The doctor should provide the patients with enough information needed for the medical decisions, which should be in an acceptive way so that the patients could understand it easily. In the test of competency, unlike the civil capacity, the understanding ability and the maturity should be considered. Patients' consent should be voluntary. The consent, including expressional and implied consent, generally can be withdrawn or exempted exceptionally, but the right should be applied carefully.
