ABSTRACT

Deontology and bioethics regulate the professional actions of doctors and dentists from a human and moral point of view. The dentist collects private information from each of his patients during the interrogation or clinical examination, and it is the dentist's obligation to keep silent about everything he sees or hears during the dental practice about the private life of his patients. The disclosure of secrets without the full authorization of the patient could undoubtedly affect their person, honor and reputation. In addition, the dentist has another type of private information about patients, known as personal data, which must be handled with great care and discretion. Professional secrecy is an ethical obligation of every dentist and its omission may bring legal repercussions. The aim of this article is to analyze the concept of professional secrecy, its ethical, deontological and legal aspects in dental practice (AU)


La deontología y bioética norman el actuar profesional de los médicos y odontólogos desde el punto de vista humano y moral. El odontólogo recaba información privada de cada uno de sus pacientes durante el interrogatorio o la exploración clínica, y es obligación del odontólogo guardar silencio de todo aquello que ve o escucha durante la consulta sobre la vida privada de sus pacientes. La revelación de secretos sin la plena autorización del paciente, podría generar sin duda afectaciones a su persona, honorabilidad y reputación. Además, el odontólogo posee otro tipo de información privada sobre los pacientes, conocida como datos personales, mismos que debe manejar con mucha cautela y discre- ción. El secreto profesional es una obligación ética de todo odontólogo y su omisión puede traer consigo repercusiones legales. ABSTRACT

Objetivo: avaliar a condição de sigilo do prontuário médico a partir da perspectiva do direito do paciente, considerando as normativas vigentes no país emanadas do Conselho Federal de Medicina. Metodologia: a pesquisa tem natureza bibliográfica e documental, consubstanciando-se em livros e artigos da área jurídica, em legislação ordinária e resoluções do Conselho Federal de Medicina. Resultados: o prontuário médico é documento complexo, que apresenta caráter informativo e científico. Confidencialidade, sigilo e segurança das informações são princípios observados quando da divulgação das informações contidas no documento. Conclusão: o prontuário médico, seja físico, seja digital, mais do que uma ferramenta de trabalho dos médicos e instituições de saúde, é um direito do paciente e que se encontra acobertado pelo sigilo em respeito à intimidade do paciente. Objetivo: evaluar la condición de sigilo del prontuario médico desde la perspectiva del derecho del paciente, considerando las normativas vigentes en el país emanadas del Consejo Federal de Medicina. Metodología: la investigación tiene naturaleza bibliográfica y documental, consubstanciándose en libros y artículos del área jurídica, en legislación ordinaria y resoluciones del Consejo Federal de Medicina. Resultados: el prontuario médico es un documento complejo, que presenta carácter informativo y científico. Confidencialidad, confidencialidad y seguridad de la información son principios observados al divulgar la información contenida en el documento. Conclusión: el prontuario médico, ya sea físico, ya sea digital, más que una herramienta de trabajo de los médicos e instituciones de salud, es un derecho del paciente y que se encuentra encubierto por el sigilo en respeto a la intimidad del paciente. Objective: to evaluate the confidentiality condition of the medical record from the perspective of the patient's right, considering the regulations in force in the country emanating from the Federal Medical Council. Methodology: the research has bibliographic and documentary nature, in books and articles of the legal area, in ordinary legislation and resolutions of the Federal Council of Medicine. Results: medical records are complex documents, which are informative and scientific. Confidentiality, confidentiality and security of information are principles observed when disclosing the information contained in the document. Conclusion: Medical records, whether physical or digital, are more than a work tool of physicians and health institutions, it is a patient's right and is covered by secrecy with respect to the patient's intimacy. ABSTRACT

Objetivo: revisar a literatura sobre os meios pelos quais o cirurgião-dentista deve orientar sua conduta, tornando- se ciente daquilo que lhe é exigido em relação à sua profissão. Materiais e método: esta revisão de literatura foi conduzida pelos principais bancos de dados de saúde: PubMed, SciELO e Google Scholar. As palavras-chave para a busca textual foram: ética profissional (ethics, professional); educação em odontologia (education, dental); odontologia (dentistry). Os critérios de inclusão foram: literatura que aborde a temática em estudo, literatura dos últimos anos, idiomas inglês e português, estudos laboratoriais e clínicos e revisão sistemática. Os critérios de exclusão foram: revisão de literatura, carta ao editor, artigo de opinião, literatura duplicada em bases de dados e literatura que não abordasse as variáveis em estudo. Revisão de literatura: a bioética baseia-se em quatro princípios básicos que estabelecem uma metodologia para analisar os casos concretos e os problemas éticos que ocorrem na prática da assistência à saúde, sendo eles: não maleficência, beneficência, respeito à autonomia e justiça. Sendo esses princípios fundamentais para o desenvolvimento da bioética, com isso, abordando uma forma peculiar de definir e manejar os valores envolvidos nas relações dos profissionais de saúde e seus pacientes. Considerações finais: a bioética deve nortear os avanços dentro do respeito ao ser humano e à sua individualidade, sem que ocorram possíveis infrações. Todavia, são necessários maiores estudos para uma maior compreensão sobre o tema e as melhores medidas para cada caso em particular. (AU)


Objective: to review the literature on the means by which dentists should guide their behavior, becoming aware of the requirements concerning their profession. Materials and method: this literature review was performed by the main health databases of PubMed, Sci- ELO, and Google Scholar. The keywords for the text search were ethics, professional; education, dental; dentistry. The inclusion criteria were the literature addressing the subject studied, the recent literature, English and Portuguese languages, laboratory and clinical studies, and systematic reviews. The exclusion criteria were literature reviews, letters to the editor, opinion articles, the literature duplicated in databases, and the literature that did not address the variables studied. Literature review: bioethics is based on four basic principles that establish a methodology for analyzing the concrete cases and ethical problems occurring in the health care practice, as follows: non-maleficence, beneficence, respect for autonomy, and justice. These are fundamental principles for the development of bioethics, hence addressing a particular way of defining and managing the values involved in the relationships between health professionals and their patients. Final considerations: bioethics should guide the advances regarding human beings and their individuality, without the occurrence of potential infractions. However, further studies are required for a better understanding of the subject and for the best measures for each particular case. (AU)

RESUMO Objetivo problematizar as condições de possibilidade para o aparecimento da atenção domiciliária no início do século XX no Brasil. Método estudo de inspiração genealógica sobre a atenção domiciliária. O material empírico foi constituído por dois documentos legais sobre o tema publicados no Diário Oficial. A análise documental utilizou as ferramentas analíticas poder, poder disciplinar e biopolítica, inspiradas em Foucault. Resultados foram elaboradas duas categorias: “Vigilância no domicílio: as enfermeiras visitadoras e a tuberculose” e “Registros: o aparelho político e econômico”. Considerações finais A tuberculose, a nova profissão das enfermeiras visitadoras, os registros produzidos pela vigilância e a análise minuciosa das cidades conferiram à atenção domiciliária um caráter de vigilância, inspeção e controle voltado a conduzir as condutas dos indivíduos.

Método se trata de un estudio de inspiración genealógica sobre atención domiciliaria. El material empírico fue constituido por documentos legales sobre el tema, publicados en el Diario Oficial. El análisis documental utilizó las herramientas analíticas poder, poder disciplinar y biopolítica, inspiradas en Foucault. Resultados fueron elaboradas dos categorías analíticas, “vigilancia en el domicilio: enfermeras visitadoras y la tuberculosis” y “registros: aparato político y económico”. Consideraciones finales la tuberculosis, la nueva profesión de las enfermeras visitadoras, los registros producidos por la vigilancia, y el análisis minucioso de las ciudades configuran la atención domiciliaria con carácter de vigilancia, inspección y control para mejor conducir las conductas de individuos.


ABSTRACT Objective to discuss the conditions that enabled home care at the beginning of the twentieth century. Method study of the genealogic inspiration on home care. The empirical material consisted of legal documents on the subject that were published in the Official Journal. The documents were studied using analytical tools, such as Power, Discipline and Biopolitics, which were inspired in Foucault. Results two analytical categories were established, “home inspection: visiting nurses and tuberculosis” and “records: political and economic apparatus”. Final considerations tuberculosis, the new profession of visiting nurses, inspection records and the detailed analysis of the cities grant home care a nature of surveillance, inspection and control to conduct the behaviour of individuals.

ABSTRACT

Social, technical and legal conditions of the current practice of medicine make it necessary to insist on certain actions and circumstances that may jeopardize the confidentiality of information, offered by patients to their health providers. Therefore, some effects of the current Chilean law are analyzed in this respect, regarding access to data from the clinical record of a patient. Also, the risks of putting certain data on social networking sites are analyzed, as well as some of its effects on clinical practice. The reasons because of mandatory reporting of diseases, meaning danger to public health, is allowed, are mentioned. We also discuss the difficulties involved in managing the results of preventative health screenings and its knowledge by third parties, as well as some possible violations of personal privacy, regarding dissemination of some people health information and its further mention or figuration in mass media. We conclude that it is a must for both physicians and other health team members, to safeguard confidentiality of data to which they have had access, as well as the need to know the relevant law, in order to respect human dignity of patients, each one as a person. We address the attention to the possibility that, practicing in a different way, it could endanger the reliability of clinical records, also impairing the quality of people’s health care.

A propriedade intelectual tem merecido destaque nas discussões atuais, trazendo àreflexão as considerações sobre o que efetivamente pode-se considerar propriedadeintelectual e científica, pelo destacado valor que se dá ao texto como registro deidéias e de organização do pensamento, bem como meio de difusão dos saberesproduzido. O que aqui se propõe é refletir, com base na legislação brasileira, sobre oque efetivamente pode-se considerar como resultado do esforço intelectual de umpesquisador ou produtor, na área da ciência, mais precisamente no âmbito daOdontologia e o que constitui dados do paciente. O prontuário odontológico tem odomínio pertencente ao paciente, como estabelece o Código de Ética Odontológica(2013). Intellectual property has been featured in the current discussions, bringing toreflection about what considerations effectively can be considered scientific andintellectual property, by the highlighted value that gives the text as a record of ideasand organization of thought as well as a means of disseminating the knowledgeproduced. What is proposed here is to reflect, on the basis of the Brazilian legislation,about what actually can be considered as a result of intellectual effort of a researcheror producer, in the area of science, more precisely in the context of dentistry andwhat constitutes patient data. However, by expressing the professional knowledge,their conclusions and evidence in any litigation, this record is fundamental to theconstruction of a dialogue between the various producers of knowledge and theirrecipients. O artigo ressalta os aspectos jurídicos dos documentos médicos, privilegiando a sua vocação como meios de prova em processos judiciais. Procurase trazer uma abordagem prática da questão dos documentos médicos, com vistas ao exercício profissional cotidiano e sem que se pretenda minimizar a importância da investigação aprofundada da matéria, e muito menos desvalorizar a finalidade principal desses documentos que decorre da sua natureza médica. Os principais instrumentos que retratam os cuidados prestados ao paciente, quais sejam Prontuário Médico, Termo de Consentimento Informado, Atestados e Receituário, são comentados sob o enfoque legal, buscando-se apontar quais características lhe conferem legitimidade jurídica


This article emphasizes the legal aspects of medical documents, giving priority to their potential use as evidence in legal proceedings. It seeks to provide a practical approach to the issue of medical documents, which is addressed to everyday professional practice but has no intention of minimizing the importance of a thorough investigation of the matter, and much less underestimating the main purpose of these documents arising from its medical nature. The main instruments that reflect the care delivered to the patient, namely, Medical Chart, Informed Consent Form, Certificates and Prescriptions, are discussed under the legal point of view, aiming to point out which features grant them legal legitimacy

Cada día asistimos con asombro a una especie de "degradación" en la confección de la Historia Clínica médica no sólo en cuanto a la escritura de los profesionales médicos, sino también en referencia a los contenidos esenciales que son inherentes a la ciencia médica. La Historia Clínica en gran número de oportunidades no refleja el intelecto y razonamiento médico sobre la patología, sino que también es frecuentemente indescifrable para otros profesionales que tienen acceso. En el presente trabajo se reúnen los tópicos fundamentales para su confección como ser la veracidad, su clara redacción, los elementos que la integran, sus funciones y determinadas características en su confección de interés médico-legal.


Every day we represent amazedly since a species of "degradation" has taken place in the confection of the clinical medical history not only as for the writing of the medical professionals but also in reference to the essential contents and that are inherent in the medical science. The clinical history in great number of opportunities does not reflect the intellect and medical reasoning on the pathology but also it is frequently undecipherable for other professionals who have access. In the present work the fundamental topics meet for his confection as being the veracity, his clear draft, the elements that integrate it, his functions and certain characteristics in his confection of medical legal interest.

Se realiza un análisis de la situación previa del Servicio Psiquiátrico Central de Varones ("Unidad 20"), y de todas aquellas reformas que tuvieron lugar a partir de las opiniones vertidas por la comisión de psiquiatras que efectuó una serie de visitas a la unidad de internación para auditar historias clínicas y entrevistarse con algunos de los internos alojados a fin de interiorizarse acerca de las condiciones de internación en dicha unidad.


The previous situation of the Central Psychiatric Unit is described, together with all the reforms taken place after the commentaries held by the commission of psychiatrists that carried out several visits to psychiatric unit. Case histories were audited and interviews were held with in-patients.

ABSTRACT

Este trabalho tem como objetivo propor o uso do Termo de Consentimento Livre e Esclarecido Ilustrado (TCLEI), adequado ao Código de Defesa do Consumidor e demais leis aplicáveis, de modo simples para profissionais e acessível aos pacientes. Tendo em vista que nos casos de processos judiciais, o ônus da prova recai sobre os profissionais, cabe a estes a responsabilidade na elaboração e arquivamento dos prontuários. A ocorrência de processos na área, envolvendo tratamentos executados em clínicas de instituições educacionais de graduação e pós-graduação em odontologia, reforça a preocupação dos docentes para a aplicação do TCLEI. A sua utilização no meio acadêmico, visa instruir e preparar os acadêmicos para a vida profissional, assim como resguardar a instituição e os docentes orientadores responsáveis pelo acompanhamento dos pacientes. É comum que pacientes destas instituições tenham dificuldade no entendimento de um termo convencional, apenas textual (AU).


This study aimed at proposing use of an Illustrated Free and Informed Consent Term (FICT), adapted to comply with the Consumer Defense Code and other relevant laws, in a fashion made simple to professionals and accessible to patients. In view of the fact that the burden of proof is on the professional in cases of legal disputes, it is the responsibility of these professionals to draft and file clinical records. The lawsuits involving treatments performed in clinics run by institutions offering undergraduate and graduate studies in dentistry reinforce the concern of professors regarding application of an illustrated FICT. Its academic implementation is intended to instruct and prepare students for their professional life, and also to protect dental professors responsible for monitoring patients (AU).
