ABSTRACT

ABSTRACT Traffic accidents and resulting injuries and deaths have become a global epidemic. In Brazil, most professional drivers, especially truck drivers, face irregular working hours and can be awake for more than 18 hours/day, which reduces their performance and alertness. In this article, we discuss the laws related to Brazilian professional drivers and their current amendments (No. 12,619/2012 and No. 13,103/2015) in relation to working hours at the wheel and rest breaks, which are vital for the quality of life of drivers and society in general. We note that the new law appears to be less efficient than the previous one as it causes insecurity and concern to the users of the transportation system, drivers, and employers. To restrict and reduce accidents, deaths, and injuries in traffic, appropriate legislation is essential, aiming at the safety of workers and users of highways. The law must also benefit the commercial aspect, strengthening the reduction in production and logistics losses. Additionally, traffic education programs are needed, as well as better supervision in relation to total working hours.


RESUMO Acidentes de trânsito com consequentes lesões e mortes têm se tornado uma epidemia em nível mundial. No Brasil, a maioria dos motoristas profissionais, sobretudo motoristas de transporte de cargas, enfrenta jornada de trabalho irregular e permanece acordado por mais de 18 horas/dia, o que reduz seu desempenho e estado de alerta. Neste artigo, discutimos as leis dos motoristas profissionais brasileiros e suas alterações vigentes (nº 12.619/2012 e nº 13.103/2015) em relação às horas de trabalho ao volante e a pausas para descanso, imprescindíveis para a qualidade de vida dos motoristas e para a sociedade em geral. Observamos que a nova legislação se mostra menos eficiente que a anterior por causar insegurança e preocupação aos usuários do sistema de transporte, aos próprios motoristas e aos empregadores. Para restringir e reduzir acidentes, mortes e lesões no trânsito, é fundamental uma legislação adequada, que vise à segurança do trabalhador e dos usuários das rodovias. A legislação deve, também, beneficiar o aspecto comercial, que se fortalece pela redução das perdas de produção e logística. Adicionalmente, são necessários programas de educação no trânsito e melhor fiscalização em relação ao tempo total de jornada de trabalho.

ABSTRACT

Karoshi remains one of the most troublesome issues in forensic identification. It is rather a social medicine than a clinical disease. Japanese scholars pioneered examining the relation between sud- den cardiac death (SCD) and chronic fatigue from long time and/or high-tension work. In the current case, a 55-year-old man, whose job was loading and carrying heavy cement bags, was found dead after 11 days of continuous hard work. His family members sued the cement factory for his death and claimed for compensation. The problem was the difficulty of identifying the causative relation without the precedent or the relevant regulations. However, the forensic problems were finally acknowledged after autopsy and calculation of labor intensity. The lawsuit was won as the first case pertaining to Karoshi in the Chinese court.

ABSTRACT

Major changes in the residency-training systems are currently under way worldwide. New laws regulating the maximum number of work-hours per week are already enforced in the USA and are soon to be enforced in the European Union (EU); they apply to residents in training, as well as to practising specialists in the USA. These changes are expected to influence training imparted to resident doctors, quality of care given to hospitalised patients and functioning of hospitals, in general. The implications of the new regulations are likely to be magnified by the gradual decrease in the number of young people willing to take up Medicine as a career and even more so by the decrease in the number of medical graduates who choose to take up Surgery as their specialty. This communication describes the new situation that has developed (especially in general surgery) with the recent regulations and intends to suggest possible solution to the important problems that are likely to arise.

ABSTRACT

Por meio da avaliaçäo da carga fisiológica do trabalho (CFT) da coleta de lixo domiciliar em amostra probabilística de setenta trabalhadores da Companhia Municipal de Limpeza Urbana do Rio de Janeiro, discute-se a adequaçäo da legislaçäo brasileira vigente quanto à classificaçäo das atividades laborativas. A CFT foi determinada para o tempo total de trabalho (TTT) e durante o tempo efetivo de coleta (TEC) através da avaliaçäo do gasto energético (GE) e da freqüência cardíaca (FC), ao longo de quatro dias consecutivos de trabalho. As medianas do GE foram 288,4 e 319,1 kcal.h-1 durante o TTT e o TEC, respectivamente, e indicam trabalho de natureza moderada pela legislaçäo. Entretanto, a CFT foi considerada pesada quando se utilizou: 1) a razäo entre o GE e a taxa metabólica de repouso (TTT 5,0 e TEC 5,6, segundo a Organizaçäo Mundial de Saúde); 2) o percentual do GE máximo (36,2 e 41,1, extrapolando o limite de 30 por cento sugerido para a atividade laboral de garis holandeses); 3) o percentual da FC de reserva (32,2 e 37,5). Os resultados demonstram a necessidade de revisäo da legislaçäo atual, para que sejam levadas em conta as características individuais na caracterizaçäo da atividade laboral.

O processo de trabalho nos bancos vem sofrendo profundas e rápidas modificaçöes, decorrentes da progressiva informatizaçäo e paralelas modificaçöes na organizaçäo do trabalho. As repercussöes destas transformaçöes nas condiçöes de trabalho e na saúde dos empregados têm sido objeto de estudos e pesquisas em nível internacional e em nosso meio. Recentemente, pesquisa sobre o perfil dos empregados em bancos,realizada pelo Iades, inclui questöes sobre saúde. Este artigo analisa a realçäo saúde/trabalho no segmento dos caixas bancários, com base no estudo desse posto de trabalho e nos dados de morbidade da pesquisa Iades
