RESUMEN
No sentido de contribuir para a compreensão desse fenômeno de judicialização da vida que experimentamos hoje em dia, esta reflexão percorre, com Michel Foucault, as trajetórias de uma genealogia das práticas jurídicas no Ocidente. Esse percurso encontra-se delineado no texto A verdade e as formas jurídicas, bem como em Vigiar e punir. Tal genealogia das práticas jurídicas mostra a formação histórica dos procedimentos de "prova", "inquérito" e "exame" - fundamentais ao exercício do direito em nossas sociedades, suas formas no antigo Direito Grego, no Direito Romano, no antigo Direito Germânico, expondo suas relações com a Inquisição, sua passagem aos modernos aparelhos de justiça, além da sua ampla difusão em práticas sociais diversas ao longo da modernidade, justamente o que remete às condições de possibilidade da judicialização contemporânea da vida. Esta reflexão busca ainda estabelecer ligações entre essas questões - presumidamente jurídicas - e a Psicologia, como campo de conhecimento e prática social.
In order to contribute to the understanding of the phenomenon of judicialization of life we experience today, this reflection goes along the lines set out by Michel Foucault through the trajectories of a genealogy of legal practices in the West. Such genealogy of legal practices, distinct from the traditional approaches of Legal Histories, shows the historical developmxnt of procedures for "evidence", "investigation" and "examination", which are fundamental for the exercise of law in our societies. From this perspective, it shows their shaping in ancient Greek Law - different from those applied in Roman Law, which in turn are different to those employed in ancient German Law - and then demonstrates their relations with the Inquisition, their transition to modern justice apparatus monopolized by the State, as well as their widespread incorporation in many social practices throughout modernity, which refers to the very conditions of possibility of judicialization of contemporary life.
