Résumé
RESUMEN Un médico está sujeto a responsabilidad civil en el ejercicio de su profesión. Bajo la ley ecuatoriana, esta responsabilidad se genera cuando se cumplen tres requisitos: actuación dolosa o culpable, daño al paciente y nexo causal entre la actuación y el daño. Cumplidos estos requisitos, nace la obligación de indemnizar. Indemnizar significa pagar una suma de dinero equivalente al daño sufrido por el paciente.
ABSTRACT A physician is subject to civil liability in his professional practice. Under Ecuadorian law, civil liability arises when three requirements are met: fraud or negligence, harm and causation between the fraud or negligence and the harm. Once these requirements have been met, an obligation to compensate is born. Compensating means paying a sum of money equivalent to the patient´s harm.
