Psicanálise e direito: um diálogo possível? / Psychoanalysis and law: a possible dialogue?

Procuro destacar a origem comum entre psicanálise e direito no teatro trágico grego e a possibilidade de se iniciar uma desconstrução do direito através do saber trágico da psicanálise. O interesse deste enfoque é fazer emergir uma compreensão trágica de "natureza humana" que fosse valiosa para despetrificar as formas muito objetivadas das leis e da prática jurídica.

I intend to enhance the common origin of psychoanalysis and law in the tragic Greek theater in order to establish some possible bonds between them, as well as to propose laws deconstruction trough psychoanalysis tragic knowledge. The interest of it might be the emergence of a tragic comprehension of "human nature" which could be precious in the despetrification of the law and of the juridical practice.

O pensamento serviço do comum: uma utopia em realização / The thought at service of the common experience: an utopia being accomplished

Este artigo pretende apresentar uma outra maneira de pensar o comum no contemporâneo – temporalidade esta que não se reduz ao pósmoderno e a seu ceticismo – assim como pensar a possibilidade de abertura ao se colocar o pensamento (psicanálise, filosofia, comunicação) a seu serviço. Trata-se de uma exigência ética para nós, mais do que um desafio, na esteira de um mundo dito sem Deus por Nietzsche. Abordo aqui a problemática da dívida simbólica e a relação com o outro sendo ele outrem (o radicalmente outro). Tomo como figura exemplar a contribuição crítica e emancipatória da ONG CEASM (Centro de Estudos e Ações Solidárias da Maré).

This article’s purpose is to present another way of considering common experience in contemporary culture, which must not be reduced to the postmodern society; as well as the possibility of thinking about some issues when we place psychoanalysis, philosophy, communication and other thought systems at its service. Such position may be considered as an ethical demand in a context of a world without God, according to Nietzsche. My approach concerns the question of symbolic debt, and the transcendent relation which we may experience with another person, when such one is considered as somebody who bears a radical strangeness – the radically other. The exemplary contribution given by the CEASM NGO (Centre of Studies and Solidarity Actions at Maré) is meant to cover our perspectives of emmancipatory thought and action.
