RESUMO
No texto da Constituição Federal e do Estatuto do Idoso, o Estado aparece cheio de poder para resolver, fazer e acontecer, mas na prática os problemas continuam sem solução. Quando os cidadãos questionam seus direitos, a resposta que recebem do Estado é que está na lei. Como se estar na lei bastasse. No entanto, quando a lei existe, mas não é cumprida, devemos questionar a sua eficácia. Este é o objetivo deste artigo, no que diz respeito à seguridade social prevista na Constituição Federal e ao Estatuto do Idoso.
In the text of the Constitution and the Statute of the Elderly, the State appears full of power to settle, and do happen, but in practice the problems remain unsolved. When citizens question their rights, the response it gets from the State is that it is the law. As if being in law was enough. However, when the law exists but is not fulfilled, we must question its effectiveness. This is the purpose of this Article, with regard to social security provided for in the Federal Constitution and the Statute of the Elderly.
