RESUMO
O presente trabalho aborda o embate entre dois grandes filósofos do direito e suas concepções acerca da discricionariedade do juiz na tomada de decisões judiciais. Analisa-se os conceitos trazidos por Dworkin ao que tange uma matriz disciplinar diferente do positivismo e em sua teoria interpretativista quanto à valoração moral e jurídica do caráter reflexivo das normas que se propõe estudar. Ocupa-se, também, acerca do pragmatismo de Posner, bem como as críticas feitas a este sistema e ambas perspectivas do posicionamento do juiz "ideal" e sua discricionariedade. O objetivo do presente trabalho é perceber e analisar a decisão judicial perante as teorias de cada um destes filósofos e adentrar as formas consideradas "corretas" que deverão servir de guia para os magistrados. Entende-se, preliminarmente, que ambas teorias possuem pontos a agregar, porém uma fusão entre estas poderia se dar de forma construtiva à teoria do direito, beneficiando à todos operadores do direito.
This paper addresses the clash between two great philosophers of law and its notion of the judge's discretion in making judicial decisions. Analyzes the concepts brought by Dworkin to respect a different disciplinary matrix of positivism and its interpretive theory about the moral and legal valuation of the reflective nature of the standards they propose to study. Is concerned, too, about Posner's pragmatism, as well as the criticisms of this system both prospects and the positioning of the "ideal" judge and his discretion. The objective of this study is to understand and analyze the ruling before the theories of each of these philosophers and into forms deemed "right" to serve as a guide for judges. It is understood, preliminarily, that both theories have points to add, but a fusion of these could give the constructive theory of law, benefiting all the jurists.
