RESUMO

RESUMEN Introducción: el concepto de calidad de vida es amplio e implica indicadores psicológicos, sociológicos, familiares, educacionales, físicos, espirituales, de salud, entre otros. A pesar de las complejidades para definir y evaluar la calidad de vida, existe consenso en admitir que, al menos una de sus aristas se vincula al ámbito económico personal y familiar. El régimen económico matrimonial es la institución que, desde el Derecho de Familia, se encarga de regular las relaciones patrimoniales de los esposos entre sí y de estos con terceros. En Cuba, el régimen económico del matrimonio corresponde a una comunidad de bienes parcial de adquisiciones onerosas y tiene carácter único, legal y obligatorio. Objetivo: argumentar la incidencia del régimen económico del matrimonio en Cuba en la calidad de vida de los ciudadanos y qué modificaciones pudieran introducirse en su regulación en el Código de Familia que se gesta en el país, para aumentar el bienestar personal y familiar. Métodos: se utilizó como método rector el dialéctico materialista, en consecuencia con la visión filosófica de los fenómenos y del mundo circundante que se tiene. Además, se emplearon métodos teóricos como el histórico-lógico y el de análisis-síntesis y métodos empíricos como el análisis de documentos. Desarrollo: se evidencia que el régimen económico del matrimonio de comunidad matrimonial de bienes existente en Cuba, contribuye a la calidad de vida de las personas en la familia, no obstante, se pudiera optimizar si se introducen en el nuevo Código de Familia cambios de un régimen legal y obligatorio a uno convencional.


ABSTRACT Introduction: the concept of quality of life is wide and implies psychological, sociological, familial, educational, physical, spiritual and well-being indicators, among others. In addition to the complexities to define and evaluate the quality of life, there is consensus in admitting that, at least one of its edges is linked to the personal and familial economic environment. The economic regime of marriage is the institution that, from the Family Code, is responsible for regulating the economic relations of the spouses among themselves and of these with third parties. In Cuba, the economic regime of marriage corresponds to a community of partial goods of expensive acquisitions and it has a unique, legal and mandatory nature. Objective: to explain the incidence of the economic regime of marriage in Cuba, concerning the quality of life and what modifications could be made in its regulation in the Family Code that is being developed in the country, to increase personal and familial well-being. Methods: materialistic dialectic method was applied as the guiding method, consequently with the philosophical vision of the phenomena and the surrounding world that one has. In addition, theoretical methods such as: historical-logical and analysis-synthesis along with empirical methods such as documentary analysis were also applied. Development: it is evident that the economic regime of the marriage of a community of property, existing in Cuba, it contributes to the quality of life of people in the family; which could be optimized if changes are introduced from a legal and mandatory regime to a conventional one in the new Code of Family.
