Este texto examina a interlocução entre trabalho e os determinantes de sofrimento no processo saúde/doença mental sob a ótica da Psicodinâmica do Trabalho. Aborda também a complexidade do nexo causal entre certas formas de organização do trabalho e o desenvolvimento de doenças, em especial os distúrbios mentais e as questões relativas ao processo de reabilitação profissional. Aponta ainda para as possibilidades de contribuições da psicologia nos espaços de escuta como via importante para auxiliar os indivíduos na relação com o trabalho. Por fim, alerta para a necessidade da neutralidade do psicólogo perante as situações desses processos, de modo a reafirmar a ética profissional na transformação da realidade social.(AU)

This text examines the interlocution between work and the determinants of suffering in the mental health/disease process from the perspective of the Psychodynamics of Work. To this end, it discusses the complexity of the causal nexus between certain forms of work organization and the development of diseases, especially mental disorders and issues related to professional rehabilitation. The discussion stresses the potential role of psychology in listening spaces to help individuals in their relationship with work. Finally, this study calls attention to the need for the psychologist to be neutral before these situations, aiming to reaffirm the professional ethics in the transformation of the social reality.(AU)

Este texto analiza la interlocución entre el trabajo y los determinantes del sufrimiento en el proceso salud-enfermedad mental desde la perspectiva de la psicodinámica del trabajo. Se aborda también la complejidad de la existencia del nexo causal entre determinadas formas de organización del trabajo y el desarrollo de enfermedades, especialmente los trastornos mentales y las cuestiones relacionadas con el proceso de rehabilitación profesional. Los resultados apuntan las posibilidades de contribución de la psicología en los espacios de escucha como una forma importante de ayudar a las personas en la relación con el trabajo. Y, finalmente, se advierte que el psicólogo debe ser neutral ante estas situaciones con el fin de reafirmar la ética profesional en la transformación de la realidad social.(AU)

Causalidad y responsabilidad médica / Causality and medical liability

Desde el inicio de la vida misma siempre han surgido interrogantes sobre el por qué suceden las cosas, el hombre en su afán desea buscar causas y los efectos de las mismas en diferentes ámbitos de la vida. En el peritaje médico es fundamental determinar las causas y los efectos o consecuencias que estas produjeron en determinadas situaciones sobre la integridad de las personas demandantes mediante una relación de causalidad o nexo causal que permita unirlas, para relacionarlas con un posible autor y establecer la presencia o no del daño causado, y de esta manera determinar la responsabilidad del autor de un hecho ilícito. En este artículo en particular, basado en términos de la responsabilidad médica y así, asesorar a la Autoridad Judicial a la hora de impartir justicia.

From the beginning of live there always questions about why things happen, men have the wish to look for the cause and effect of them in different field of the live. The forensic expert evaluation is fundamental to determine the causes and the effects or consequenses that this produce in different situation on the integrity of the person who demand through the causation relation or the causal nexus, that permit to unit them with a possible author and establish the presence or not of the injury caused, and in this way determine the responsibility of the author of and ilicit act. In this article in particular, based on terms of medical responsibility, therefore asesorate the Judicial Autority to concede justice.

Does company compliance with RS-17 influence the characterization of a casual nexus in expert testimony?

Objective: To examine whether company compliance with RS-17 influences the characterization of the casual nexus in physical therapists' expert reports of cumulative trauma disorders in the labor court of Pernambuco, Brazil. Method: The sample was composed of seven physical therapists who provided expert testimony regarding cumulative trauma disorder cases in the labor court of Pernambuco, Brazil. Data collection was performed across two stages. In the first stage, the experts answered a sociodemographic survey and requested the identification numbers of recent cases where expert testimony was provided to characterize the causal nexus. In the second stage, the researchers went to the labor court to collect expert testimony data. These experts indicated that of 75 total cases, 31% (N=23) of the companies fulfilled RS-17, whereas 69% (N=52) did not comply with the law. Results: Among the organizations that complied with legislation, 30% of the analyzed expert testimonies showed a positive causal nexus. However, of the companies that did not comply with RS-17, 71% of the expert testimonies revealed a causal nexus. These results indicate that the breach of the law increases the probability that a causal nexus will be determined by 54.8%. Conclusion: The results showed that failure to comply with RS-17 significantly increases the probability that a causal nexus will be determined in physical therapists' expert testimony of cumulative trauma disorders. .

O nexo causal em saúde/doença mental no trabalho: uma demanda para a psicologia / The causal nexus on mental health/illness related to work: a new demand for psychology

Estabelecer o nexo causal em saúde/doença mental no trabalho tem se apresentado como uma nova demanda à psicologia como ciência e profissão nos seus diferentes campos de atuação. Este texto examina a interlocução entre trabalho e saúde/doença mental no percurso histórico da psicologia. Apresenta, também, alguns procedimentos referentes ao diagnóstico e à justificativa de nexo causal entre trabalho e quadros psicopatológicos com base na Portaria do 1339/99 do Ministério da Saúde do Brasil. Mesmo admitindo o reducionismo que a relação causal produz em se tratando de quadros psicopatológicos, a exigência legal a impõe para o reconhecimento como doenças relacionadas com o trabalho e o acesso aos benefícios previdenciários decorrentes.

Establishing the causal nexus on mental health/illness related to work is a new demand for psychology as a science and as a profession in all fields of activity. This text examines the interlocution between work and mental health/illness in the course of the history of psychology. It also presents some procedures referring to the diagnosis and the justification of the causal nexus between work and psychopathological illness. Even if we consider the causal nexus as a reductionism in psychopathological illness, this is a legal requirement to be recognized as an illness related to work and to obtain social welfare agency benefits.
