RESUMO

Through the brief introduction of the concept of the mobile medical , this paper pointed out that the ethical issues that exist:health data reliability problems , the patient′s privacy protection , the protection of intellec-tual property rights issues , is involved in the problem of illegal practice medicine , online consulting the legal re-sponsibility of the doctor -patient relationship to define problems , make the reductionism , highlighted the defect of mind-body dualism and instrumental rationality overflow problem .And from the technical level , the law , the poli-cy level and consciousness discusses the related countermeasures .

RESUMO

Making out medical record is one of the fundamental obligations of doctors in medical service. Primarily, the meaning of medical record is the logical basis to guarantee consistent medical practice by writing out the detailed process, which could make the doctors remember the items of what they have done for their patients. But, nowadays when the medical service is highly specialized and differentiated, it also means not only the important method of communication amongst specialized medical divisions but also legal basis for adjudicating the appropriateness of medical practice at the court. In the process of medical practice, it would be inevitable for personal information, health information and genetic information to be disclosed. On the one hand, doctors meet the legal and ethical obligation to protect the right of privacy of their patients, on the other hand, they bear the legal obligation to observe the rule for the patients' right to know and right of self determination for private information. So, therefore, even if doctors are to provide medical record by the legal provisions, they should inform the patient of the reality and maximum careful attention should be paid in order to minimize the extent of exposure of patients' personal information, health information and genetic information.

In the recent years,infringement on patients' privacy in medical activities is drawing wider attention.In medical practice there exit some common phenomena of this kind,such as some medical staff spreading the information of medical record to irrelevant people,going beyond their duty to pry into or deliberately disclose patients privacy,intentionally harass of directly intrude upon patients' private parts,etc.These problems can be gradually reduced or avioded by strengthening medical staff's awareness of self-discipline,offering related education and advice to patients,and perfecting relevant laws and regulations.

There is no defined legislation on paternity testing in present China,thus the testing status quo is in a mess to some extent.Together with other unfavorable factors including the unstable marital status in modern society,increasing extramarital sexual behaviors and illegitimate children,and the ever-heated testing competition among testing institutes driven by the economic interests and so forth,the paternity testing is on a sharp rise these years,which leads to a increasing chaos in paternity testing field.Social ethical crisis is partially responsible for the current problem,thus related ethical issues to paternity testing are discussed in this article.

RESUMO

Protection for privacy is the guarantee for sustaining personal dignity and individual liberty.Protection for patients' privacy has a long history and is of great realistic significance.However,patients with A H1N1 Influenza are facing the risk of exposing privacy in current circumstances.This paper argues that the privacy protection for this particular population is beneficial both for social and public interests,and also can be justified from an ethical perspective.
