Progress in standard assessment on competency to stand trial of mentally disordered offenders / 法医学杂志

Competency to stand trial relates directly to legal rights of the appraised individual as well as whether criminal procedure can be carried out smoothly. Foreign scholars have conducted a large number of theoretical researches, and developed a series of standardized evaluation tools. However, the assessment on competency to stand trial has mainly focused on medical criteria in China for a long time, and most cases were judged by forensic psychiatrists' experience. Recently, Chinese scholars have started the initial research on standardized evaluation. This paper reviews the notion of competency to stand trial, the evaluation criteria, and the assessment tools domestically and abroad. The main focus is on foreign assessment tools, which included three categories. First category includes checklist, self-report questionnaires and sentence-completion tasks. Second category is the interview-based instruments without criterion-based scoring. Last category is the interview-based instruments with criterion-based scoring. This literature may be helpful for further research and standardization on assessment tools of competency to stand trial of mentally disordered offenders.

Schizophrenia is the most common in forensic psychiatry. The motive, the style and the consequence of any schizophrene's misdeed have its own particularity. So schizophrenia is significant in the forensic practice. The characteristics of schizophrene's misdeed and the peace breaker's responsibility, competence to stand trial and to serve a sentence werereviewed.

Role of forensic psychiatrist in updating investigation of crime by mentally ill subjects.

Forensic medicine, the subject in undergraduate medical curriculum is becoming more and more important for undergraduate students. Forensic psychiatry is being very much felt an important part of crime and criminology and is being thoroughly neglected. We cannot ignore the mental status of a person in relation to commission of a crime as it is the case in all spheres of life. So updating forensic psychiatry in educational programme may play key roles in crime investigations. The law can judge the merit of a case on the basis of how far the mental abnormality might influence to commit a crime. Investigation of crime has to be a compulsorily team work consisting of man of forensic psychiatry or at least forensic medicine expert and the other investigating agencies.

Actos homicidas en pacientes internados en el Instituto Nacional de Psiquiatría "Gregorio Pacheco" 1985 - 1994 / Homicide actions of inpatient ot the National Psyquiatric Institute \"Gregorio Pacheco\" 1985-1994

El presente trabajo los autores hacemos conocer la gran importancia de la Psiquiatria Forense y la relación estrecha o mutua con la ley. Por los antecedentes de homicidio existentes en pacientes con patologia psiquiatrica; se efectuó un estudio estadistico de 2.265 ingresos en el Instituto Nacional de Psiquiatria "Gregorio Pacheco", de la ciudad de Sucre, año 1.985 a 1.994. Los resultados son: 26 ( 1.15 porciento) pacientes con anteedentes homicidas o lesiones leves a gravisimas; correspondiendo 17 al sexo masculino y 9 al femenino. En ninguno de los casos remitidos por orden judial, se realizó peritaje psiquiátrico. Se recomienda la creación de un Centro Penitenciario Especializado para la atención adecuada.
