RESUMO

O presente texto versa sobre as experiências na América Latina na temática de violência contra as mulheres no que concerne a legislações e abordagens institucionais no sistema de justiça, com enfoque em seis países Argentina, Brasil, Colômbia, Costa Rica, Guatemala e Uruguai. O texto é produto de revisão documental e bibliográfica para desenho de pesquisa no âmbito do projeto O Poder Judiciário no Enfrentamento à Violência Doméstica e Familiar contra Mulheres, desenvolvido pelo Ipea em parceria técnica com o Conselho Nacional de Justiça (CNJ). A partir do estudo de documentos internacionais, legislações e pesquisas institucionais e acadêmicas sobre o tema, apresentam-se as relações normativas e práticas dos países às recomendações internacionais do Comitê de Experts (Cevi), do Mecanismo de Seguimento da Convenção de Belém do Pará (MESECVI). Embora se verifiquem adequações às recomendações internacionais, as reflexões orientam para a força dos elementos locais na aplicação do transnacional, uma vez que interposições estruturais e valorativas definem distanciamentos normativos e institucionais.

ABSTRACT

This current work deals with experiences in Latin America on the theme of violence against women, concerning legislation and institutional approaches in the justice system, focusing on six countries Argentina, Brazil, Colombia, Costa Rica, Guatemala and Uruguay. The text is the product of a documental and bibliographic review for research design within the scope of the project The Judiciary in Confronting Domestic and Family Violence against Women, developed by Ipea in technical partnership with the National Council of Justice (CNJ). Based on the study of international documents, legislation and institutional and academic research on the subject, the normative and practical relations of the countries are presented to the international recommendations of the Committee of Experts (Cevi), of the Follow-Up Mechanism to the Belém do Pará Convention (MESECVI). Although there are adjustments to the international recommendations, the reflections guide to the strength of local elements in the application of the transnational, since structural and evaluative interpositions define normative and institutional distances.
