Giorgio Agamben identifica uma recusa do direito em reconhecer uma esfera da ação humana em si extrajurídica. Visando ultrapassar essa barreira, ele eleva uma frase de Schmitt à dignidade de um matema "Soberano é quem decide sobre o estado de exceção". Matema que articula três elementos indissociáveis soberania, decisão e estado de exceção.
