RESUMO
No Brasil a saúde foi erigida à condição de direito a partir da Constituição Federal de 1988. Entretanto, após quase três décadas da criação do SUS os cidadãos brasileiros ainda apresentam dificuldades para efetivação deste direito social. Como consequência, temos um número elevado de ações judiciais tendo como objeto o requerimento de procedimentos e insumos de saúde, fenômeno este que ficou conhecido com judicialização da saúde e, mais especificamente no campo da Assistência Farmacêutica (maioria das solicitações), judicialização de medicamentos. Neste aspecto, a presente dissertação teve por objetivo analisar os itinerários e percepções dos requerentes que pleitearam medicamentos por via judicial no município de Vitória da Conquista/BA nos anos de 2013 e 2014. Para tanto, foi realizada uma pesquisa qualitativa através da realização de entrevista semi-estruturada de onde emergiram informações que permitiram a interpretação e a análise dos itinerários e percepções dos usuários. Além disso, foi elaborado um fluxograma para melhor descrição do itinerário dos sujeitos. (...) A peregrinação do indivíduo em busca do tratamento medicamentoso mostrou-se bastante penoso. O desgaste causado pelas negativas, pela desinformação, pela burocracia e pelo tratamento, por vezes, desumanizado acaba por aumentar o sofrimento durante a busca. A judicialização mostrou-se como um dos últimos recursos utilizados pelo cidadão na peregrinação em busca do tratamento medicamentoso. Porém, em alguns casos, nem mesmo a via judicial foi capaz de efetivar o direito à saúde almejada pelo cidadão. Percebe-se que são necessárias ações públicas no sentido de promover a ampliação do acesso aos medicamentos para a população, através de uma melhor estruturação dos serviços e disponibilização de recursos para tal, para que os cidadãos possam efetivamente ter um sistema de saúde pautado nos princípios da universalidade e da integralidade.
ABSTRACT
In Brazil, health was raised to the condition of social right by the Federal Constitution of 1988. However, after three decades of SUS (Single Health System) creation, Brazilian citizens are still having difficulties for carrying out this social right. As a result, we have a high number of judicial actions having as object the application procedures and health inputs, a phenomenon that became known as judicialization of health, and more specifically in the field of Pharmaceutical Care (most of the requests), judicialization of medicines. In this sense, this current study aimed to analyze routes and perceptions of applicants who pleaded drugs through the courts of Vitoria da Conquista city - Bahia in the years 2013 and 2014. Therefore, a qualitative survey was conducted by interviewing achievement semi structured where emerged information that allowed the interpretation and analysis of routes and perceptions of users. In addition, it designed a flow chart for a better description of the itinerary of the users. (...) The pilgrimage of the persons in search of medical treatment was very painful. The fret caused by the refusals, by misinformation, by bureaucracy and treatment sometimes dehumanized ends up increasing the suffering during the search. The judicialization proved to be one of the last resources used by citizens in pilgrimage in search of medical treatment. However, in some cases, not even the courts were able to carry the right to health desired by citizens. It is noticed that are necessary public actions to promote increased access to medicines to the population through a better structuring of services and availability of resources to do so, so that citizens can effectively have a health system guided by the principles of universality and comprehensiveness.
