RESUMO
Esta dissertação buscou remontar o percurso documental da Ação Direta de Inconstitucionalidade (ADI) 4.275 que transcorreu no Supremo Tribunal Federal entre 2009 e 2018. O objeto desta ação, acolhida a partir da inicial proposta pela Procuradoria Geral da República em 2009, é a possibilidade de mudança de prenome e sexo jurídico nos registros civis, sem a exigência de cirurgia de transgenitalização. Para a elaboração desta dissertação recorreu-se aos documentos oficiais que fizeram parte do processo judicial da ADI 4.275 disponibilizados no site do Supremo Tribunal Federal, bem como aos vídeos das sessões de julgamento no STF disponibilizados pela TV Justiça. Os vídeos das sessões de julgamento trazem um material rico e vivo, porque possibilita observar a interação entre os ministros, a apresentação de suas dúvidas sobre os termos utilizados, os embates, as lembranças de outros julgamentos, entre outras interações que ocorrem durante as sessões. Esses vídeos serão igualmente tratados como documentos. A metodologia recorre a um alinhamento temporal dos documentos para uma análise qualitativa, a fim de cercar expressões centrais na discussão do tema em seu alinhavo com a "gramática jurídica", tornando visíveis metamorfoses dentro e fora das sessões de julgamento em torno do direito à identidade de gênero. A atenção recairá na amarração e fabricação de conceitos que se formam no encontro entre os campos dos defensores dos direitos humanos, dos militantes, do judiciário e da academia, fato essencial para a compreensão do desenlace da ação
ABSTRACT
This paper aims to trace the documentary course of the Direct Action of Unconstitutionality (ADI) 4275 heard before the Federal Supreme Court between 2009 and 2018. The object of this action, accepted from the initial proposal by the Attorney General's Office in 2009, is the possibility of changing the name and legal sex with civil registries, without proof of sex reassignment surgery. This thesis was based on official documents attached to the records of ADI 4275 that are available on the website of the Brazilian Federal Supreme Court, as well as the videos of the sessions heard in the Federal Supreme Court and made available by TV Justiça (broadcaster). The videos of the sessions provide a productive and dynamic material, as they allow us to observe the interaction between justices, their questions about the expressions used, the disagreements, recalls of other trials, among other interactions that occur during the sessions. These videos are also treated as documents. The methodology uses a temporal alignment of the documents for a qualitative analysis, to surround central expressions used to discuss the theme in line with the "legal grammar", making the metamorphoses visible both inside and outside the sessions reviewing the right to gender identity. This paper focus on the connection and production of concepts that are created in the encounter among the human rights defenders, militants, the judiciary and the academia, which is essential for understanding the outcome of the action
