RESUMO

O livre arbítrio dos julgadores na valoração do dano vem acarretando grandes divergências noque respeita ao quantum indenizatório estipulado, principalmente, quando há envolvimento de da¬nos morais. A literatura sobre as implicações desse tema é vasta, mas no que diz respeito às lesões do complexo maxilomandibular limita-se às referências dos fatos, sem o adequado aprofundamento da discussão. Analisaram-se jurisprudências relacionadas à perda de dentes anteriores através dos acórdãos emitidos pelos Tribunais de Justiça de alguns estados brasileiros, no período compreendido entre janeiro de 2005 a novembro de 2010, que condenavam os réus ao pagamento de indenizações materiais e morais decorrentes de lesões corporais. Os acórdãos foram obtidos através do site do Tribunal de Justiça e analisados individualmente quanto aos valores indenizatórios arbitrados, comparando-os com danos odontológicos da mesma natureza. Observou-se que existe, para situações de traumas semelhantes, uma grande divergência na estipulação do valor pecuniário decorrente dos da¬nos odontológicos, especialmente quando envolvem danos morais, indicando a necessidade de uma referência comum para os setores que participam, respectivamente, da avaliação clínica e jurídica.

ABSTRACT

The discretion of judges in assessing the damage has been causing major differences withregard to the indemnity stipulated quantum, especially when involving punitive damages. The lite¬rature on the implications ofthis subject is vast, but with regard to injuries of maxillo-mandibular particularly limited references to the facts, without the proper depth of the discussion. We con¬ducted an analysis of case law related to loss of anterior teeth by the judgments issued by Courts of Justice in some Brazilian states, the period from January 2005 to November 2010, condemning the defendants to pay damages and pain and suffering arising injuries. The judgments were obtained through the website of the Court and examined individually as to the arbitrated values for material and moral damage, compared them with similar dental damage. It was observed that there exists for situations like trauma, a wide divergence in the stipulation of the monetary value of damages due dentistry, especially when they involve damages, indicating the need for a com-mon reference for the sectors involved, respectively, of the clinical evaluation and Legal.
