Actitud del cirujano dentista en cuanto al tipo de contrato realizado en la prestación de servicios / Actitud of dentist in relation to type of the contract to provide services

ABSTRACT

This study must by objective verify the type of hiring made by the dentists and the attitude of such in the cases of failure of the dentistry treatment. They participated, after consentient, all the dentists of River of Stone - Brazil (n=20). A questionnaire with open questions was applied relative to the way of hiring made by such. The data were classified and analyzed by the qualitative method. It was perceived that most of the professionals it does not make any type of contract with his patients (60%). Some (15%) assure not to make written contract, only verbal. Between that they alleged to make contracts, some use those elaborated by lawyers (20%) or dentist unions (20%). On the conduct in cases of failure in the treatment, a parcel of the professionals responded that, although they had early clarified the risk of the treatment, they look for the causes of the failure, and try correction (55%). Another part (35%) assured that its conduct in cases of failure would be to remake the treatment without additional costs for the patient, or the indication for other professionals (10%). One concluded that the formal contract accomplishment is not unanimous between the professionals. The majority related to remake the treatment without weight for the patient in the cases of failure, same free of fault. With that, the idea that is fortified a handbook with the suitable registry of the procedures, allowed and made, acquires greater legal meaning than the contractual document itself.

RESUMEN

Este estudio tiene por objetivo verificar el tipo de contratación realizado por los cirujanos dentistas y la actitud de los mismos en los casos de fracaso del tratamiento odontológico. Participaron de la investigación, después de aceptar, todos los cirujanos dentistas de Río de las Piedras-SP - Brazil (n=20). Fue aplicado cuestionario con preguntas abiertas relativas al modo de contratación realizada por los mismos. Los datos fueron clasificados y analizados por el método cualitativo. Se percibió que la mayoría de los profesionales (60%) no realiza ningún tipo de contrato con sus pacientes. Algunos, aseguran realizar sólo contrato verbal (15%). Entre los que alegaron realizar contratos, algunos utilizan aquellos elaborados por abogados (20%) o por sindicatos odontológicos (20%). Sobre la conducta en casos de fracaso en el tratamiento, más de la mitad (55%) respondió que, aunque habían clarificado anticipadamente el riesgo del tratamiento, buscan las causas del fracaso, e intentan corregirlas. Otra parte aseguró que su conducta en casos de fracaso sería rehacer el tratamiento sin costos adicionales para el paciente (35%), o el encaminamiento para otros profesionales (10%). Se concluyó que no es unánime entre los profesionales la realización de contrato formal. La mayoría relató rehacer el tratamiento sin peso para el paciente en los casos de fracaso, mismo libre de culpa. Con eso, se fortalece la idea de que un prontuario con el registro adecuado de los procedimientos, consentidos y realizados, adquiere mayor significado legal que el documento contractual propiamente dicho.
