RESUMO

O artigo objetiva discutir a situação dos adolescentes em privação de liberdade no que se refere ao atendimento público em saúde. Parte-se do pressuposto de que o direito à saúde vem sendo negado, mesmo que o Estatuto da Criança e do Adolescente já exista há duas décadas. A materialidade deste direito específico depende de mudanças estruturais rigorosas entre as políticas de base social, no que concerne aos patamares de financiamento, às suas formas de gestão e, nomeadamente, do tipo de postura que o Estado tem assumido frente à questão da criança e do adolescente. A estratégia da intersetorialidade se revela fundamental, porém depende de um lastro de variáveis ainda não consolidados no país.

ABSTRACT

The article aims to discuss the situation of adolescents in the deprivation of liberty with regard to the public in health care. It is assumed that the right to health has been denied, even though the status of children and adolescents already exist for two decades. The materiality of this specific duty depends on rigorous structural changes between basic social policies, on the terraces of funding and its forms of management and in particular the type of attitude that the State has taken forward the issue of children and adolescents. The strategy of intersectoral approach is crucial, but it depends on a variable ballast still not consolidated in the country.
