RESUMO

O presente artigo discute a atualidade das relações entre direito e psicanálise e suas aplicações práticas, tendo como eixo condutor os efeitos da função do pai, tanto na constituição subjetiva quanto no ordenamento jurídico. Investigamos a possibilidade de criar, no universal desse ordenamento, um espaço para a singularidade do sujeito que, muitas vezes, chega às portas da justiça à procura de algo que intervenha como ordenação subjetiva. A lei do pai, com sua função estruturante, se encontra no cerne da constituição do sujeito e dos fundamentos da cultura, operando uma subtração do gozo pulsional e retornando sob os efeitos de um mal-estar que afeta tanto o corpo do sujeito quanto o corpo social.

ABSTRACT

This article discusses the relevance of the relationship between psychoanalysis and law and its practical applications, taking for direction the drive the effects of father's role, both in subjective constitution and the legal system. We investigate the possibility of creating, in this universal system, a space for the singularity of the subject that often approaches justice looking for something to intervene as a subjective ranking. The law of the father, with its structuring role, is at the heart of the constitution of the subject and of the foundations of culture, operating a subtraction of instinctual enjoyment and returning under the effects of a malaise that affects both the body of the subject and the society.

Cet article traite de l’actualité des relations entre le droit et la psychanalyse et ses applications pratiques, ayantcomme axe conducteur les effets du rôle du père, aussibiendans la constitution subjective, quedans le systèmejuridique. Nous avons étudié la possibilité de créer, dans la dimension universelle de cet ordre, un espace pour la singularité du sujet, qui, souvent, arrive aux portes de la justice à la recherche de quelque chose qui puísse intervenir comme un ordonnancement subjectif. La loi du père, avec son rôlestructurant, estaucoeur de la constitution du sujet et des fondements de la culture, et opère une soustraction de la juissancepulsionelle, en reapparessantsous les effetsd’un mal-êtrequiaffecte à la fois le corps du sujet et le corps sociale.
