Paternidade: O Ponto de Vista de Profissionais Que Atuam em Varas de Família / Paternity: The Point of View of Professionals That Work in Family Courts

RESUMO

Este estudo teve como objetivo conhecer quais as percepções acerca da responsabilidade parental e do lugar do pai na família, bem como os desafios que tem se colocado em relação à paternidade no cotidiano de trabalho de profissionais que atuam em varas de famílias. Para tanto, entrevistas semiestruturadas foram realizadas com juízes e promotores, sendo a análise realizada por meio da análise de conteúdo temática. Os relatos indicam um novo olhar em relação à paternidade, ao mesmo tempo em que as concepções tradicionais ainda predominam. Percebeu-se que a guarda compartilhada tem encontrado resistências no âmbito judiciário, o que leva a pensar que superar a visão da mãe como naturalmente melhor preparada para cuidar dos filhos e reconhecer no pai alguém que pode compartilhar a parentalidade, mais do que somente prover financeiramente a família, parece ser o desafio que se coloca a todos.(AU)

ABSTRACT

This study aims to learn what the conceptions assigned to parental responsibility and the father's place in the family, as well what the challenges regarding fatherhood in daily work of professionals working in family courts. Therefore, data were collected through semi-structured interviews of judges and prosecutors, analyzed according to the assumptions of thematic content analysis. Reports indicate a new look at paternity, while traditional concepts still prevail. Moreover, we noticed that joint custody has found resistance within the judiciary, which suggests that to overcome the view that the mother is better prepared to care for children and recognize the father someone who can share parenting more than just provide financially for the family, seems to be the challenge for all.(AU)
