RESUMEN
En el marco de la gran reforma normativa del CoÌdigo Civil y Comercial de la NacioÌn en el anÌo 2015, se ha incorporado a la normativa interna una nueva mirada en torno a las personas menores de edad, con relacioÌn a su capacidad, a la participacioÌn en el desarrollo de su vida y en la toma de decisiones de cuestiones relacionadas con su propio cuerpo y su salud. El objetivo del presente trabajo es el de poner a disposicioÌn del equipo meÌdico de salud, las previsiones legales y normativas relacionadas con este nuevo paradigma, a fin de que tomen conocimiento del tema y apliquen estos nuevos conceptos en las situaciones que se presenten en la actividad asistencial, entendiendo que ello brindaraÌ una mejor atencioÌn y calidad de salud para los usuarios del sistema de salud. La metodologiÌa utilizada resulta del anaÌlisis y detalle de la normativa existente, tanto internacional que da marco al presente, como de la nacional en el cumplimiento del ejercicio profesional. En ese sentido, se presenta como un aporte al mejoramiento de la forma de ejercer la actividad sanitaria y el desarrollo de la tarea asistencial para todos los profesionales de la salud y equipo de apoyo.
ABSTRACT
Within the framework of the great normative reform of the National Civil and Commercial Code in 2015, a new look has been incorporated to the internal regulations regarding minors, in relation to their capacity, to their participation in the development of their life and in the decision making of issues related to their own body and health. The aim of this paper is to make available to the medical health team the legal and regulatory provisions related to this new paradigm, so that they become aware of the subject and apply these new concepts to the situations that arise in the health care activity, understanding that this will provide better care and health quality for the health system users. The methodology used is the result of the analysis and detail of the existing regulations, both national and international. The former seeks the proper fulfilment of professional practice, whereas the latter provides the framework of the present article. In this sense, it is presented as a contribution to the improvement on this bases of exercising the activity and the development of the healthcare task for all medical professionals and support team.
