Judicialización del derecho a la salud / Judicialization of the right to health

RESUMEN

En los últimos años es cada vez más frecuente el recurrir a la justicia para exigir el cumplimiento del Derecho a la Salud. Esta situación se ha denominada Judicialización o Activismo Judicial. Este Activismo Judicial refleja algunas cuestiones que se deben considerar. Por un lado, el aumento de las demandas puede ser un reflejo de las desigualdades sociales, de la inequidad en el acceso a la salud y del déficit de cobertura en salud. Por otro lado, puede significar mayor acceso a la información y mayor concientización y apropiación de la salud como un derecho. La intervención judicial en muchos casos sirve para restituir los derechos desde lo individual, ante situaciones concretas, pero no es suficiente para restaurar las dificultades que tiene el sistema de salud, y muchas veces las acciones colaboran al aumento de las desigualdades.

ABSTRACT

In the last years,it is more and more frequent appealing to the justice to demand the fulfillment of the right to health. This situation has been named Judicialization or Judicial Activism and reflects some issues that must be considered. On one hand, the increase of the demands could be the reflection of social inequalities, inequities in the access to health and the health coverage deficit. And on the other hand, it could mean more access to information and, awareness and appropriation of the right to health. The judicial intervention, in many cases, is useful to restore individual right to specific situation, but it is not enough to restore health system´s difficulties, and often these actions collaborate to increase inequalities.
