RESUMEN

Las migraciones humanas, del siglo XXI son distintas de las precedentes que han habido, gracias a las revoluciones tecnológicas, la de las comunicaciones, las cuales, están modificando los elementos de relación política, jurídica, social y cultural de esos colectivos y sus inserciones, tanto en la sociedad receptora como la de origen, en especial en ámbitos vitales como los del trabajos, identidad social, producción de capitales y transferencia de conocimientos. Estos impactos tradicionalmente ha sido promotora de emigrantes, en especial, hacia los estados Unidos y en fecha reciente a otras zonas del planeta. Permitiendo el surgimiento de una forma social nuevo de bicolectivos dentro de una nueva geopolítica de laingencia humana, que esta planteando nuevos derechos que implican un reto al Derecho Internacional, que patentizan las insuficiencias del estado-nación para hacer justicia a esos conjuntos de seres humanos implicados por el fenómeno de la migración dentro del contexto de la globalización y su marco democrático. Sin embargo, hay señales que indican que la democracia no está bien preparada para lo que está implicando con esas transformaciones que plantean las migraciones en el plano de la globalización que reporta la revolución tecnológica, pues ya la democracia es una forma de vida más que de gobierno. Por estas razones, deseamos explorar, con este escrito, esas relaciones en el contexto globalizado en América latina y el Caribe.

ABSTRACT

The human migrations, in the XXI century are qualitatively different from the ones that happened before, thanks to the technical revolutions, in special, the communicational revolutions, the ones are substantially modifying the elements of political, legal, social and cultural relations of the collectivity and their incursions in the receptive society and in the society of origin, specially in vital ambits such as work, social identity, capital production and knowledge transfer inside of what as been called globalization. These impacts are of extreme relevance in Latin America and the Caribbean because the societies of this region traditionally have been promoter of emigrants, in a special case, towards the USA and in recent times to other parts of the planet. Allowing so the outcome of a new social form of bio-collectives inside of a new geopolitics of the human ingencia, and that is creating new rights that imply a challenge to the International Right that makes its one the insufficiencies of the nation-state to make justice to those new conglomerates of human beings that are involved bye the migration phenomena inside the context of globalization and its democratic marc. However, there are very significant signals that indicate the democracy is not well prepared for what the changes caused by the migrations in the globalization scale are implying, because democracy is a form of life instead of a way of rule. For these reasons, we wish to explore the relations in the globalized context of Latin America and the Caribbean, putting an emphasis in the fact that it is very disturbing for the justice of the international relations and for the good relations between the internationalpolicies, the reduction of these to a paradigm of national security, preventive war policies that began coming to action after the 9-11 terrorist attacks in NY and after the terrorist attacks in Madrid, promoting with this unclear violations of immigrant’s Human Rights.
