RESUMEN

Desde la complejidad, fundamentada en el pensamiento complejo, se pretende hacer un aporte en el entendimiento de las consideraciones a tomar en cuenta para la comprensión y el manejo del final de la vida en nuestro contexto sociocultural, avizorando un nuevo marco jurídico, para la comunidad médica venezolana. La autora haciendo uso de la hermenéutica, busca aproximarse a la realidad para aprehenderla, a través del lenguaje cualitativo, vinculándose al fenómeno de interés con intensión creadora, genuina y holística, con el fin último de aportar nuevos constructos teóricos, que llevados a la práctica permitan un mejor manejo del paciente terminal al final de la vida. Las circunstancias derivadas de la medicalización de la muerte, han proporcionado legitimidad a los reclamos por una "muerte digna", dando paso a la creación de espacios para el debate de los distintos aspectos que se deben considerar con relación a los problemas Bioéticos ante el Dilema Omega. Con la Reforma del Anteproyecto del Código Penal, se pretende dar categoría legal al hecho de "dar muerte por piedad", sin contemplarse los distintos aspectos que deben someterse a consideración ante esta difícil y delicada toma de decisiones. Es momento para la reflexión que oriente la dinámica social, de ciudadanos con la resiliencia para adaptarse a las inflexiones propias de los tiempos actuales. Debemos crear espacios para la integración del saber y la sana convivencia, donde la conducta de sus mujeres y hombres sea el reflejo de valores orientados al máximo desarrollo humano ante la máxima posibilidad técnica.

ABSTRACT

Based upon complexity and the complex thought, the author aims to contribute in the comprehension of different dimensions to be considerate in understanding medical life decision, regarded our socio-cultural context and the legal framework modifications, for the Venezuelan medical community. The author through a systematic theory of the hermeneutic, through qualitative language, allows the best approach to reality in order to apprehend the phenomenon in a creative, genuine and holistic scientific perspective, to contribute with an original theoretical construct, which is taken to practice, guides a better medical handling of terminally ill patients at end of making life decision. The circumstances derived from the medicalization of disease, have provided legitimacy to dignify death reclamations, which have brought to light the imminent requirement of deliberations of all important matters to account in Bioethical-Biotechnological concerns in the Omega Dilemma. Actually we are undergoing a reformation of the first Draft of the Penal Code, in which it is pretended to give legal category to the fact of "giving death by mercy", without considering very important aspects that must be put under evidence in this difficult and delicate situation. It is time to reflect and innovative in upcoming social dynamics, among a society with the resilience to adapt to the inflexions of the present times. We must create novel workplaces towards the integration of knowledge and respectful-healthy coexistence, to promote behavior on our women and men is the reflection of maximum human values oriented to our growth and development within a maxima technical capability.
