Pesquisa de células-tronco humanas e a efetividade do direito à vida / Stem cell research and the effectiveness of the human right to life

RESUMO

O presente estudo tem como objetivo apresentar uma discussão de índole constitucional sobre a pesquisa de células-tronco humanas. Iniciou-se a abordagem do tema proposto com a elucidação da diferença entre língua e linguagem para poder chegar na interpretação constitucional com ênfase nos direitos fundamentais e, por derradeiro uma abordagem acerca da pesquisa de células-tronco humanas com um olhar da bioética. Dentre esses direitos fundamentais será sobre o direito à vida que gravitarão as celeumas e conclusões do presente trabalho. Partindo da discussão travada na mais alta corte de justiça do país (STF) de quando se começa a vida, para que sobre tal decisão fosse julgada a Ação Direta de Inconstitucionalidade (ADI N) a fim de elucidar se a pesquisa com células-tronco humanas embrionárias viola o direito à vida, bem como se há violação da dignidade da pessoa humana.

ABSTRACT

This study aims to present a discussion of research on the constitutional nature of human stem cells. It started to approach the theme with the elucidation of the difference between language and language to get the constitutional interpretation with emphasis on fundamental rights, and last about a stem cell research with a look of bioethics. Among these fundamental rights will be on the right to life that gravitarão fussabout and the conclusions of this work.
