Judicialização da questão social e a banalização da interdição de pessoas com transtornos mentais / Judging the social issue and making the adjudication of insanity banal

RESUMO

Resumo O artigo analisa o protagonismo do Poder Judiciário no enfrentamento da questão social, no bojo dos processos de interdição de pessoas com transtornos mentais. A judicialização da questão social se dá a partir da transferência de responsabilidades do Poder Executivo para o Judiciário no que se refere à garantia de direitos sociais, levada a cabo no processo de interdição, o que acaba privando os interditados do gozo dos direitos civis e políticos. Tal procedimento revela, sob uma nova roupagem, a face conservadora e coercitiva do Estado.

ABSTRACT

Abstract This article aims at analyzing how the Judicial Department deals with the social issue, in the processes of adjudication of insanity. Judging the social issue is accomplished by transferring the Executive Department's responsibilities to the Judicial Department as to guarantee the social rights in the process of adjudication, which ultimately deprives the interdicted of the enjoyment of their civil and political rights. We have concluded that such a procedure reveals the state's conservative and coercive aspect, under a new guise.
