Criação e regulamentação de uma nova lei para o exercício profissional da enfermagem (1980-1987)

RESUMO

Trata de estudo histórico social que tomou como objeto o movimento da enfermagem para criação e regulamentação de uma nova lei para o exercício profissional da enfermagem, no período de 1980 a 1987. O marco inicial refere-se ao ano em que foi encaminhado à Câmara dos Deputados, o anteprojeto de lei para regulamentação da profissão e o marco final corresponde ao ano em que foi publicado o Decreto n. 94.406 de 8 de junho de 1987 quere gulamenta a nova Lei do Exercício Profissional da Enfermagem, Lei 7.498, de 25 de junho de 1986. Nesse contexto, os objetivos da dissertação foram descrever as circunstâncias que delinearam o arcabouço legal do exercício profissional da enfermagem até 1980 e analisar o movimento da enfermagem para a criação e regulamentação da Lei nº 7498, de 25 de junho de1986. O estudo teve como referência analítica os conceitos de habitus, campo, capital e poder e violência simbólica do sociólogo francês Pierre Bourdieu. Esses conceitos foram úteis à compreensão de que os agentes envolvidos na luta pela criação e regulamentação da nova Leido Exercício Profissional investiram o capital simbólico apreendido no e pelo campo, na luta para fazer valer suas visões de mundo. As fontes primárias foram os documentos escritos localizados no Conselho Regional de Enfermagem do Rio de Janeiro, no Centro de Documentação da Escola de Enfermagem Anna Nery da Universidade Federal do Rio de Janeiro, no Portal da Presidência da República, do Senado e Câmara dos Deputados. As fontes secundárias foram livros, artigos científicos, dissertações e teses sobre a temática. Os principais resultados indicam que o fortalecimento da enfermagem brasileira como profissão tem percorrido longa e articulada trajetória que se desencadeou na primeira metade do Século XX...

ABSTRACT

This is an historical and social study which took as object the nursing movement to create andregulate the professional practice of nursing, during the period from 1980 to 1987. The initialmark refers to the year in which it was forwarded to the Chamber of Deputies, the draft billfor the regulation of the profession and the final mark corresponds to the year when waspublished the decree No 94,406 of 8 June 1987 regulating the new law of the professionalpractice of nursing, Law 7.498, in 25 June 1986. In this context, the objectives of thedissertation were to describe the circumstances that outlined the legal framework of theprofessional practice of nursing until 1980 and analyze the movement of nursing for thecreation and regulation of law No. 7498, 25 June 1986. As analytical reference we have usedthe concepts of habitus, field, capital and power and symbolic violence of the Frenchsociologist Pierre Bourdieu. These concepts were valuable for understanding ththat the agentsinvolved in the struggle for the creation and regulation of the new law of professional practicehave invested the symbolic capital acquired in and by the countryside, in the fight to asserttheir worldviews. The primary sources were the written documents located in the NursingCouncil of Rio de Janeiro, in the Documentation Centre of the Anna Nery School of Nursingat the Federal University of Rio de Janeiro, on the website of the Presidency of the Republic,the Senate and House of Representatives. The secondary sources were books, scientificarticles, dissertations and thesis which have produced about the subject.
