Bioética e biojuridicização na reprodução humana assistida / Bioethics and biolaw in assisted human reproduction

RESUMO

A bioética é um ramo da ética que discute as intervenções biológicas na estrutura biológica humana que provocam dúvidas quanto ao respeitoou não aos valores éticos. Está associada à genética e à reprodução humana, bem como às técnicas de fertilização. As técnicas de reprodução humana assistida (RHA) têm como objetivo a geração de novos indivíduos. Trata-se de um tema polêmico e atual que desencadeia debates éticos equestionamentos jurídicos, visto que interfere no processo de procriação natural do homem, desafiando o direito, principalmente no que tange àsrelações de parentesco, fazendo com que o conceito de filiação seja repensado. As procriações artificiais perturbaram as representações tradicionais dos modos de concepção e das estruturas de parentesco. A fecundação in vitro criou uma situação especialíssima na história da maternidade pela primeira vez, o início da vida humana pode se dissociar do corpo da mulher geradora. Portanto, no caso da RHA, especificamente a fecundação in vitro, criou-se uma situação totalmente inédita para a qual não existe nenhuma legislação ou, quando muito, legislações previstas para circunstâncias diferentes, mas que não impedem hoje o uso impróprio dessas técnicas aplicadas à RHA. Sem dúvida, a bioética não pode e nem deve ignorar o processo legislativo, mas manter-se aberta às vozes ativas do campo da reprodução humana. Reconhecer esse dado significa respeitar o ser humano em si mesmo, durante todo o seu desenvolvimento, e para além dele próprio, os seus semelhantes.

ABSTRACT

The bioethics is a branch of ethics that discusses the biological interventions in human biological structure, causing doubts in what concerns the fact of respecting or not the ethical values. It is associated to the genetics and human reproduction, as well as fertilization techniques. The assistedhuman reproduction (AHR) techniques have the objective of generating new individuals. It is a controversial and current theme that unleashes ethical debates and juridical issues, because it interferes in the natural process of human procreation, challenging the law, mainly the family relationship, andinciting a new point of view over the concept of affiliation. The artificial procreations disturb the traditional representations of conception and kinship structures. The fecundation in vitro created an exceptional situation in the history of the maternity for the first time, the beginning of human life could be dissociated of woman’s body. Therefore, in AHR cases, specifically in vitro fecundation, a brand new situation has been brought up for which no legislation was regulated; legislations are used for different circumstances, but do not block the inappropriate use of those applied techniques to AHR. There is no doubt that the bioethics can not ignore the legislative process, but it also has to be opened to the active voices of human reproduction field. Recognizing these data means respecting humans during all their development and beyond the individuals, referring to their fellow creatures.
