ABSTRACT

For the purposes of this work, children with disabilities include disabled children or children aged 0 to 8 years who are not recognized as disabled in the prescribed manner, but who have temporary or permanent deviations in physical and (or) mental development (hereinafter - children with disabilities). The legislative basis for the implementation of the rights and opportunities of children with disabilities and their families is constituted by constitutional provisions that enshrine state guarantees for the protection of childhood, motherhood, paternity, family (part 1 of article 38, paragraph "g.1" of part 1 of article 72 of the Constitution of the Russian Federation). An early start of comprehensive care for children with disabilities contributes to the maximum possible achievements in the development of the child, maintaining his health, as well as successful socialization and inclusion of the child in the educational environment with subsequent integration into society. The research material was the international treaties and regulatory legal acts of the Russian Federation on providing early assistance to children with disabilities. The work used a set of methods of scientific knowledge, including general scientific methods: analysis, synthesis, induction, deduction, special: comparative, formal legal, etc. Legislative consolidation of the institution of providing early assistance to children with disabilities can be carried out by amending the existing legislative acts or by adopting a separate regulatory legal act of the legislative level that establishes the legal basis for providing early assistance. This article outlines the directions for improving legal regulation in terms of legislative consolidation of the institution of providing early assistance to children with disabilities by amending the current legislative acts of the federal level.

ABSTRACT

The article presents information about a significant number of people older than working age, disabled people and recipients of social services in stationary form and about the unfavorable forecast of the number of people older than 65 years for 2024 and 2030 in the Russian Federation, which determines the need for legal regulation of their lifestyle issues with respect for human rights to lead an independent lifestyle. The authors present an analysis of the federal and regional legal framework in terms of determining the circumstances under which a citizen is recognized as needing social services, the participation of local self-government bodies and subordinate organizations in the provision of social services, the implementation of social support, the introduction of hospital-substituting social service technologies. The article discusses the trends and ways to improve the legal regulation of social services for elderly and disabled citizens at home from the perspective of the introduction of hospital-substituting elements.

ABSTRACT

The article presents a comparative analysis of the effectiveness of the individual rehabilitation programs among elderly citizens and disabled persons of the Astrakhan region, the part of the South Federal District of Russia. We analyzed the data of the statistical survey of the social services provided rehabilitation facilities for the elderly and disabled people in the Astrakhan region. Analytical results thus obtained shown that the network of agencies and centers of social rehabilitation in the Astrakhan region did not correspond to the needs of elderly people and disabled persons. The negative dynamics in the number of social care centers as well as in the number of people who were provided with their services revealed the need for optimization of the institutional structure and its management. These specific characteristics of the social rehabilitation services in the Astrakhan region thus identified should be taken into consideration in order to improve the rehabilitation programs among elderly citizens and disabled persons in the South Region of the Russian Federation.

ABSTRACT

The systematic review and data analysis of the social services legislative regulation among elderly citizens and disabled persons in Russian Federation was submitted. The structure of the consolidated legislation on social services among citizens of advanced age was defined. The Russian legislative database in all subjects of the Russian Federation was analyzed. Analytical results thus obtained made it possible to designate the subjective rights of elderly citizens in the field of social services, the lists of bases for providing social services, different kinds of these services according to the consolidated legislation in all subjects of the Russian Federation, and various legal organizational forms providing these social services also.

ABSTRACT

A comparative data analysis of the federal statistical survey of social services for the elderly citizens and disabled persons in outpatient departments and day hospitals in Russian Federation was submitted. It included the data on the number of organizations providing social services, the number of individuals served, the number of full-time staff positions for the years 2006-2011. It had been revealed that during this period the number of social rehabilitation centers, health centers and hospices for the elderly citizens were reduced in Russia that in turn caused the significant decrease of hospital beds and persons served per year. The data on the activities of hospitals and residential institutions in social services system for the elderly citizens and disabled persons, as well as the number of persons served over the period of 2009-2011 had been analyzed. Analytical results thus obtained shown that one of the new approaches in solving these sociogerontological problems on system management of outpatient departments, day hospitals and residential institutions in Russia are an optimization of the institutional structure, reorganization of hospital beds capacity, refurbishment of present and construction of new buildings.
