ABSTRACT

In this paper I critically examine the implications of the uncodifiability thesis for principlism as a pluralistic and non-absolute generalist ethical theory. In this regard, I begin with a brief overview of W.D. Ross's ethical theory and his focus on general but defeasible prima facie principles before turning to 2) the revival of principlism in contemporary bioethics through the influential work of Tom Beauchamp and James Childress; 3) the widespread adoption of specification as a response to the indeterminacy of abstract general principles and the limitations of balancing and deductive approaches; 4) the challenges raised to fully specified principlism by the uncodifiability thesis and 5) finally offer a defense of the uncodifiability thesis against various critiques that have been raised.

ABSTRACT

This article discusses an approach to translational bioethics (TB) that is concerned with the adaptation-or 'translation'-of concepts, theories and methods from bioethics to practical contexts, in order to support 'non-bioethicists', such as researchers and healthcare practitioners, in dealing with their ethical issues themselves. Specifically, it goes into the participatory development of clinical ethics support (CES) instruments that respond to the needs and wishes of healthcare practitioners and that are tailored to the specific care contexts in which they are to be used. The theoretical underpinnings of this participatory approach to TB are found in hermeneutic ethics and pragmatism. As an example, the development of CURA, a low-threshold CES instrument for healthcare professionals in palliative care, is discussed. From this example, it becomes clear that TB is a two-way street. Practice may be improved by means of CES that is effectively tailored to specific end users and care contexts. The other way around, ethical theory may be enriched by means of the insights gained from engaging with practice in developing CES in a process of co-creation. TB is also a two-way street in the sense that it requires collaboration and commitment of both bioethicists and practitioners, who engage in a process of mutual learning. However, substantial challenges remain. For instance, is there a limit to the extent to which a method of moral reasoning can be adapted in order to meet the constraints of a given healthcare setting? Who is to decide, the bioethicist or the practitioners?

On March 20, 2022, the General Office of the CPC Central Committee and the General Office of the State Council issued The Opinions on Strengthening Ethical Governance of Science and Technology, which put forward five ethical principles of science and technology: promoting human well-being, respecting the right to life, adhering to fairness and justice, reasonably controlling risks and maintaining openness and transparency. Ethical principles require to be studied and interpreted concretely by ethical scholars, that is, first, they need to be refined in order to be truly guided; second, the principle of balance is needed to truly guide; third, it is necessary to study ethical theory in order to truly guide; fourth, it is significant to explore Chinese civilization in order to truly guide. In this way, the ethical principles of science and technology can be practically applied and guide the concrete practice of science and technology.

ABSTRACT

Rarely do everyday discussions of ethical issues invoke ethical theories. Even ethicists deploy ethical theories less frequently than one might expect. In my experience, the most powerful ethical arguments rarely appeal to an ethical theory. How is this possible? I contend that ethical argumentation can proceed successfully without invoking any ethical theory because the structure of good ethical argumentation involves leveraging a sturdy norm, where the norm is usually far more specific than a complete ethical theory. To illustrate this idea, I present the argumentative structure of five powerful articles in the ethics literature. I further argue that the present model of ethical argumentation is consistent with the coherence model of ethical justification, but the former need not--and usually should not--invoke the latter explicitly for various practical reasons.

ABSTRACT

The enrichment of bioethical proposals built from and for Latin America has been increasing in recent decades. In order to contribute to this, our objective is to present a proposal for a bioethical interpretation from a philosophical approach based on the identification of central concepts of Mexican philosopher Juliana González Valenzuela. A dual bio-ontological foundation was identified: a) the "dialectic phenomenology of life," which allows the synthesis between the biological and cultural aspects of human beings, as well as the overcoming of its contradictions; and b) the Homo humanus, which enables the existence of the bio-ethical being affirmed as an authentic being and one who seeks a good life (eu-bios and eu-zoein). Reflection on and critique of the implications that the bio-ontological foundation hypothetically couples to law and power led us to identify main arguments. However, the necessary link between the bio-ethical being and said disciplines was evidenced by virtue of their social and communitarian nature (zoon politikón, ζῷον πολῑτῐκόν).


El enriquecimiento de las propuestas bioéticas construidas desde y para Latinoamérica ha ido en aumento en las últimas décadas, a efecto de contribuir a ello es que nuestro objetivo es presentar una propuesta de interpretación bioética en clave filosófica a partir de la identificación de los conceptos centrales de la filósofa mexicana Juliana González Valenzuela. Se identificó un doble fundamento bio-ontológico: a) la "fenomenología dialéctica de la vida" que permite la síntesis entre el aspecto biológico y cultural del ser humano, así como la superación de sus contradicciones; y b) el Homo humanus que posibilita la existencia del ser bio-ético afirmado en tanto un ser auténtico y en tanto busca una vida buena (eu-bíos y eu-zoein). La reflexión y crítica de las implicaciones que el fundamento bio-ontológico apareja hipotéticamente al derecho y al poder, nos llevó a identificar las principales líneas argumentativas, pero principalmente se evidenció el vínculo necesario entre el ser bio-ético y dichas disciplinas, en virtud de su naturaleza social y comunitaria (zoon politikón, ζῷον πολῑτῐκόν).

ABSTRACT

Evaluating readiness for discharge from the intensive care unit (ICU) is a critical aspect of patient care. Whereas evidence-based criteria for ICU admission have been established, practical criteria for discharge from the ICU are lacking. Often discharge guidelines simply state that a patient no longer meets ICU admission criteria. Such discharge criteria can be interpreted differently by different healthcare providers, leaving a clinical void where misunderstandings of patients' readiness can conflict with perceptions of what readiness means for patients, families, and healthcare providers. In considering ICU discharge readiness, the use and application of ethical principles may be helpful in mitigating such conflicts and achieving desired patient outcomes. Ethical principles propose different ways of understanding what readiness might mean and how clinicians might weigh these principles in their decision-making process. This article examines the concept of discharge readiness through the lens of the most widely cited ethical principles (autonomy [respect for persons], nonmaleficence/beneficence, and justice) and provides a discussion of their application in the critical care environment. Ongoing bioethics discourse and empirical research are needed to identify factors that help determine discharge readiness within critical care environments that will ultimately promote safe and effective ICU discharges for patients and their families.

Background: Artificial intelligence (AI) is predicted to be a solution for improving healthcare, increasing efficiency, and saving time and recourses. A lack of ethical principles for the use of AI in practice has been highlighted by several stakeholders due to the recent attention given to it. Research has shown an urgent need for more knowledge regarding the ethical implications of AI applications in healthcare. However, fundamental ethical principles may not be sufficient to describe ethical concerns associated with implementing AI applications. Objective: The aim of this study is twofold, (1) to use the implementation of AI applications to predict patient mortality in emergency departments as a setting to explore healthcare professionals' perspectives on ethical issues in relation to ethical principles and (2) to develop a model to guide ethical considerations in AI implementation in healthcare based on ethical theory. Methods: Semi-structured interviews were conducted with 18 participants. The abductive approach used to analyze the empirical data consisted of four steps alternating between inductive and deductive analyses. Results: Our findings provide an ethical model demonstrating the need to address six ethical principles (autonomy, beneficence, non-maleficence, justice, explicability, and professional governance) in relation to ethical theories defined as virtue, deontology, and consequentialism when AI applications are to be implemented in clinical practice. Conclusions: Ethical aspects of AI applications are broader than the prima facie principles of medical ethics and the principle of explicability. Ethical aspects thus need to be viewed from a broader perspective to cover different situations that healthcare professionals, in general, and physicians, in particular, may face when using AI applications in clinical practice.

ABSTRACT

It can be assumed that value judgements, which are needed to judge what is 'good' or 'better' and what is 'bad' or 'worse', are involved in every decision-making process. The theoretical understanding and analysis of value judgements is, therefore, important in the context of bioethics, for example, to be able to ethically assess real decision-making processes in biomedical practice and make recommendations for improvements. However, real decision-making processes and the value judgements inherent in them must first be investigated empirically ('empirical bioethics'). For this to succeed, what exactly a 'value judgement' is and of what components it might consist must initially be theoretically clarified. A corresponding conceptual model can then support or even enable empirical data collection and analysis and, above all, subsequent ethical analysis and evaluation. This paper, therefore, presents a value judgement model with its theoretical derivation. It also illustrates its application in an interview study of decision-making between animal experimentation and alternative methods in the context of biomedical research. Though the model itself can be theoretically deepened and extended, the application of the model works in general and helps to uncover what value judgements can enter into decision-making. However, the empirical methods, for example, qualitative interviews, can also be better oriented towards eliciting value judgements (as understood according to the model). Further applications of the model to other topics or by means of other empirical methods are conceivable.

ABSTRACT

Green hotels have grown in popularity due to customers' increased awareness of environmental issues. This study aims to construct and evaluate a model that combines the theory of Planned Behavior (TPB) and the theory of ethics to explain green hotel visitors' intentions and behavior. The study also considers the role of trust & subjective norms as a moderator. The framework of the study was evaluated using a quantitative method. Most of the respondents to the study, which was carried out in Noakhali, Bangladesh, were students at Noakhali Science and Technology University and their family members. The data was collected from 414 respondents and analyzed using the structural equation modeling (SEM) technique. The data collection took around two weeks, starting from December 3, 2021. According to the study's findings, the deontological (Moral obligation and justice) and teleological variables (perceived benefit and perceived risk) significantly influence green hotel visitors' intentions and actual behavior. Moreover, trust noticeably influences the relationship between subjective norm (SN) and Intention, and subjective norm affects the connection between attitude and intention. Therefore, hotel management can utilize this research to examine and understand visitors' intention and actual behavior to visit green hotels, which will assist them in attracting guests by portraying their services as eco-friendly. Furthermore, the findings may help hotel management formulate competitive marketing strategies, design effective promotional tools, and help generate an eco-conscious customer base.

Resumo As tecnologias da informação e comunicação têm influência cada vez maior na área da saúde, sendo o aumento significativo do recurso à teleconsulta um reflexo disso. Os benefícios que essa modalidade de prestação de serviços de saúde ocasiona são inquestionáveis, a começar pelo facto de auxiliarem a enfrentar os desafios contemporâneos que assolam os sistemas de saúde em todo o mundo. Todavia, a sua crescente utilização vem sublinhar a importância de salvaguardar questões éticas relacionadas com a autonomia, equidade, privacidade e qualidade da relação entre o utente e o profissional de saúde. Este artigo pretende estimular uma reflexão acerca dos desafios éticos que se colocam antes, durante e após o uso da teleconsulta, com o intuito de otimizar e modelar a sua utilização.


Abstract Information and communication Technologies are increasingly present in health care, as exemplified by the recourse to remote consultation. Such care delivery modality brings unquestionable benefits, such as helping to face the contemporary challenges plaguing health systems worldwide. But its ever-increasing use underlines the importance of safeguarding ethical issues related to autonomy, equity, privacy, and the quality of the user-professional relations. This paper reflects on the ethical challenges presented before, during, and after remote consultation as to optimize and shape its use.


Resumen Las tecnologías de la información y la comunicación tienen una influencia cada vez mayor en el área de la salud, y esto lleva a un aumento significativo en el uso de la teleconsulta. Muchos son los beneficios de esta modalidad de prestación de servicios sanitarios, comenzando por el hecho de que ayudan a abordar los desafíos contemporáneos que afectan a los sistemas de salud en todo el mundo. Sin embargo, su uso creciente destaca la importancia de salvaguardar las cuestiones éticas relacionadas con la autonomía, la equidad, la privacidad y la calidad de la relación entre el paciente y el profesional de la salud. Este artículo pretende incitar a una reflexión sobre los desafíos éticos que surgen antes, durante y después del uso de la teleconsulta, con el fin de optimizarlo y modelarlo.

ABSTRACT

The exponential advancement of health technologies has led to an increasing need for awareness and critical thinking about the potential unintended consequences and ethical dilemmas that may arise from using new technologies. Unfortunately, many ethical issues arise post-implementation. Few researchers preemptively consider the ethical implications of health technologies. The current study located more than 24 million articles in PubMed that discussed common health technologies. Of these, 0.07% (n = 17,816) articles deeply considered the technology's potential ethical implications. Critical thinking and ethics are the mainstays of nursing practice. Thus, critically thinking about the potential ethical implications of relevant technologies should be at the forefront of research; we contend that this is not common practice. We hope to shed light on this issue to remind researchers to think like nurses when researching new health technologies.

Resumo Ao longo da história, a ética médica assumiu diferentes perspectivas. Na atualidade, parece haver indiscutível supremacia do entendimento de que a ética normativa é aquela que melhor atende às necessidades da relação de profissionais da medicina com seus pacientes. Nesse contexto, esta pesquisa buscou investigar como a ética das virtudes pode contribuir para que a deontologia médica possa ser eficaz e virtuosa com vistas ao bem do paciente. Para buscar essa compreensão, realizou-se pesquisa bibliográfica de caráter teórico-conceitual narrativa e crítica. A hipótese levantada é de que, embora a deontologia seja o guia mais aceito e praticado na relação do profissional com o paciente, se não for acompanhada de uma ética das virtudes para orientar a ação médica, não há garantias de que o mero cumprimento da regra seja virtuoso no que tange ao bem do paciente.


Abstract Throughout history, medical ethics has taken on different perspectives. Nowadays, the indisputable understanding seems to be that of the supremacy of normative ethics as the one that best meets the needs of the relationship between medical professionals and their patients. Given this context, this investigation sought to understand how the ethics of virtues can contribute so that medical deontology can be effective and virtuous targeting the well-being of patients. To seek this understanding, a bibliographic search of narrative and critical theoretical-conceptual character was carried out. The hypothesis is that although deontology is the most accepted and practiced guide in the professional-patient relationship, if it is not accompanied by an ethics of virtue to guide medical action, there is no guarantee that the mere fulfillment of the rule is virtuous with regard to the patient's well-being.


Resumen La ética médica adoptó diferentes perspectivas a lo largo de la historia. Parece existir actualmente una indiscutible supremacía de que la ética normativa es la que mejor responde a las necesidades de los profesionales médicos y sus pacientes. Por tanto, esta investigación buscó evaluar las posibles contribuciones de la ética de las virtudes para que la deontología médica pueda ser eficaz y virtuosa con vistas al bien del paciente. Para comprenderla, se realizó una investigación bibliográfica teórica-conceptual narrativa y crítica. Se partió de la hipótesis de que cuando la deontología, a pesar de ser la guía más aceptada y practicada en la relación del profesional con el paciente, no va acompañada de una ética de las virtudes destinada a guiar la conducta médica, no está garantizado que el mero cumplimiento de las reglas la haga virtuosa con respecto al bien del paciente.

Background: The value framework governing the health system can guide the policymaking. This study presents a set of values governing the health policies for adopting policies that are in harmony with the ideology of Iran. Methods: This study was conducted in two phases. In the first phase, using the qualitative approach, Shams et al. framework was adopted to identify values. Identification of health-related national documents (nine documents) was performed purposefully. In the next phase, semi-structured interviews on individual experts in the health system were carried out. The key question was "What values and principles govern the health policy system?" Participants included 15 individuals. Both phases were analyzed based on qualitative content analysis. Results: In this study, a taxonomy of values governing policymaking is presented. Results show that equity in different dimensions, comprehensive health and a healthy human being, pioneering in health in the region, and accountability are the most important terminal vaqlues. Individual responsibility, government responsibility for health, endogenous and extrinsic economics, fair access, transparency, efficiency, quality and integrity in the supply, development and fair allocation of public health resources, and professional commitment are the most important instrumental values in Iran. Participants believed that, despite the many higher-order documents available, the health system policymaking was not based on a predetermined value. Conclusions: It is not enough to provide a set of values in upstream documents for implementation. It is necessary to specify the relative weight of the reference values in policymaking and their relation to each other in order to apply them in policymaking.

BACKGROUND: Given the increased use of technology in health care, both in extent and application, the importance of understanding the ethical implications of new health technologies increases. Profound insight into the possible ethical implications of new health technologies enhances the research and development of such technologies and the likelihood of eventual successful implementation in clinical practice. OBJECTIVE: This study aimed to gain an understanding of how and if researchers focused on health technologies describe the actual or possible ethical aspects of their research findings. METHODS: An established framework for scoping reviews was used to guide the methodology. Studies published in PubMed over the last 10 years were included if they study or refer to ethics in relation to health technology as defined by established frameworks. In total, 14,532 articles were screened, 692 were retained for full-text evaluation, and 227 were included for data extraction. RESULTS: In total, 250 (80.9%, N=309) studies were conducted in North America and Europe; literature review studies were dominant. Most studies (52.9%, 120/227) had no direct reference to any of the 4 basic ethical principles: beneficence, nonmaleficence, autonomy, and justice. In cases where studies referenced ethical theory, consequentialism dominated. CONCLUSIONS: When research about technology and ethics is published, the predominant focus is on its intent rather than its actual effect on patients. This lack of insight is problematic considering the vast advancement of technology in which ethics cannot keep up with understanding and offer insights on addressing ethical issues. This finding has implications for practice, research, and education.

Resumo Conhecer o paradigma ético que fundamenta o código moral da medicina é fundamental para atuar não só na assistência, mas também em processo pericial. A partir de revisão da literatura, propõe-se avaliar a maneira como os quatro princípios éticos fundamentais (beneficência, não maleficência, autonomia e justiça) se aplicam antes, durante e após a perícia psiquiátrica, como perito ou como assistente técnico. Novos desafios éticos vêm surgindo na psiquiatria forense. Com a pandemia de covid-19, a tecnologia foi adotada para permitir a prática da telemedicina, mas ainda se debate se seria suficiente para promover avaliação pericial psiquiátrica adequada. Considerando a complexidade da área, cada situação deve ser analisada de forma individual e abrangente, sendo recomendável buscar auxílio para debater as perspectivas éticas e legais das perícias psiquiátricas quando necessário.


Abstract Knowing the ethical paradigm that bases the medicine moral code is fundamental to act not only in care but also in the expert testimony process. From a revision of the literature, we propose to evaluate the way the four fundamental ethical principles (beneficence, nonmaleficence, autonomy, and justice) apply before, during, and after the psychiatric expert testimony, be it as expert or as technical assistant. New ethical challenges have been appearing in forensic psychiatry. With the COVID-19 pandemic, technology was adopted to allow the practice of telemedicine, but debates still occur if that would suffice for an adequate psychiatric expert testimony evaluation. Considering the complexity of the area, each situation must be analyzed in an individualized and all-encompassing way and seeking help to debate the ethical and legal perspectives of psychiatric expert testimonies is recommended when necessary.


Resumen Conocer el paradigma ético que subyace en el código moral de la medicina es fundamental para actuar no solo en la asistencia, sino también en el proceso pericial. A partir de una revisión bibliográfica, se propone evaluar cómo se aplican los cuatro principios éticos fundamentales (beneficencia, no maleficencia, autonomía y justicia) antes, durante y después de la pericia psiquiátrica, ya sea como perito o como asistente técnico. Están surgiendo nuevos desafíos éticos en la psiquiatría forense. Con la pandemia del Covid-19, se utilizó la tecnología para permitir la práctica de la telemedicina, pero aún está en debate si esto es suficiente para promover una adecuada evaluación psiquiátrica forense. Considerando la complejidad del área, se debe analizar cada situación de manera individual e integral y, cuando sea necesario, buscar ayuda para debatir las perspectivas éticas y legales de la pericia psiquiátrica.

ABSTRACT

BACKGROUND: Values are at the heart of discussions related to policy-making and any kind of reforms in health systems. Despite wide recognition of its importance, the concept of value is still vague and the policy-making processes remain astray with respect to values. This study aims to provide a model of value-based policy-making and to explain the concept value and how it affects policy-making. METHODS: The main question of the current study is to explain the concept of value-based policy-making and developing a model, based on the explained concept. In this line, critical review method and Carnwell and Daly approach and using particular keywords related to stewardship, and searching databases were used. In the initial search, 739 studies were obtained, of which using targeted sampling method, 11 studies were finally selected. Then, in order to design and explain different aspects of the value concept in the health system and to develop a model, selected studies were criticized, and finally, the conceptual model of value is designed and explained. RESULTS: The concept of value and its effects, dimensions and its relation to principles, evidence and criteria were determined at different stages of the policy-making process. It was also revealed that value-based policy-making in a health system is contingent upon the realization of terminal values. CONCLUSIONS: In the process of selecting the best policy option, it is necessary to identify the relationship between terminal, instrumental, criterion, and evidence to avoid deviating from the reference value framework in any country and to avoid blindly imitating other experiences in other countries.

No presente estudo, os autores se propõem a avaliar o conhecimento e a postura dos docentes de uma universidade pública do Nordeste do Brasil frente aos artigos 34 e 35 do Código de Ética Odontológica, relativos ao magistério. Por meio de um questionário com quesitos discursivos, os docentes efetivos que se dispuseram a participar (61%) demonstraram em grande parte conhecer a legislação ética e adotar uma postura adequada, havendo, todavia, divergência quanto à possibilidade de flexibilização para a participação de graduandos em cursos de pós-graduação, o que contraria a legislação do ensino e pode demonstrar interesse na prática como forma de incentivar o mercado do ensino odontológico... In the present study, the authors propose to evaluate the knowledge and posture of professors at a public university in the Northeast of Brazil in relation to articles 34 and 35 of the Dental Code of Ethics, related to teaching. The research was made by means of a questionnaire with discursive questions and the effective professors who were willing to participate (61%) demonstrated to have a large knowledge of the ethical legislation and to adopt an adequate posture, however, there was disagreement as to the possibility of flexibility for the participation of undergraduates in post-graduation courses, which goes against the teaching legislation and may show interest in practice as a way to encourage the dental education market... Resumo Está cada vez mais evidente que a reflexão sobre ciências humanas e deontologia é necessária para a formação mais abrangente do estudante de medicina, visando preparar não apenas profissionais tecnicamente capacitados, mas também humanizados. Diante disso, e a fim de seguir as diretrizes curriculares nacionais atuais, as Faculdades Integradas do Norte de Minas instituíram módulo no sexto período de medicina chamado "Humanidades, Bioética e Antropologia Médica". Objetivando avaliar a percepção de alunos sobre o ensino de ética nessa instituição, esta pesquisa aplicou questionário a estudantes do sétimo ao décimo períodos do curso de medicina. O instrumento contava com perguntas sobre a estruturação do módulo e o ensino de ética. Os resultados evidenciaram a proposta inovadora do módulo e a importância da ética médica na grade curricular no sentido de contribuir para a formação de médicos mais humanos.


Abstract It is increasingly evident that reflection on humanities and deontology is necessary for a more comprehensive training of medical students, aimed at preparing professionals that are not only technically qualified, but also humanized. For this reason and also to follow the current national curriculum guidelines, Faculdades Integradas do Norte de Minas introduced a new module in the sixth period: "Humanities, Bioethics and Medical Anthropology." Aiming to evaluate student perception about the teaching of ethics in the institution, this research applied a questionnaire to the students (seventh to tenth period) of the medical course. The instrument comprised questions on the module's structure and the teaching of ethics. Results show the importance of including medical ethics in the medical curriculum for a more humanized formation of doctors.


Resumen Cada vez es más evidente que la reflexión sobre humanidades y deontología es necesaria para la formación integral del estudiante de medicina, con el objetivo de preparar no solo profesionales técnicamente calificados, sino también humanizados. Por lo tanto, y con el fin de seguir las actuales directrices curriculares nacionales, las Facultades Integradas del Norte de Minas establecieron un módulo en el sexto período de medicina denominado "Humanidades, Bioética y Antropología Médica". Con el fin de evaluar la percepción de los estudiantes sobre la enseñanza de la ética en esta institución, esta investigación aplicó un cuestionario a estudiantes del séptimo al décimo período de la carrera de medicina. El instrumento tenía preguntas sobre la estructuración del módulo y la enseñanza de la ética. Los resultados mostraron la propuesta innovadora del módulo y la importancia de la ética médica en el plan de estudios para contribuir a la formación de futuros médicos más humanos.
