ABSTRACT
Resumen: En el presente artículo, los autores tratan el tópico de admisibilidad en Chile de las acciones de responsabilidad civil de wrongful conception o anticoncepciones fallidas. Utilizando referencias hacia la práctica en el derecho comparado y al derecho internacional de los derechos humanos, los autores argumentan a favor de fundamentar su reparación en el derecho a la autodeterminación reproductiva de las mujeres.
Abstract: In this article, the authors refer to the wrongful conception claims, particularly the controversy of their admission in Chile. On the basis of comparative and human rights international law, the authors argue in favor of the women's right to reproductive self-determination as the foundation of their compensation.
Resumo: Neste artigo, os autores abordam o tema da admissibilidade no Chile das ações de responsabilidade civil de wrongful conception ou anticoncepções fracassadas. Com base em referências para a prática no direito comparado e no direito internacional dos direitos humanos, os autores argumentam a favor de fundamente sua reparação o direito à autodeterminação reprodutiva das mulheres.

En el presente artículo se aborda un tema de actualidad dentro de la responsabilidad médica: la obligación de medios y la de resultados. Si bien la primera es la que predomina en cualquier relación médico paciente, existe algunas especialidades como cirugía estética, radiología, radioterapia, anatomía patología y anestesia, en las que la obligación de resultados ha venido a formar parte de muchos de sus procedimientos. Con base en estos supuestos se exploran casos de la jurisprudencia Argentina y española y se nota cómo esta última ha evolucionado al punto de no abordar un caso a priori como de obligación de medios o de resultados, sino analizarlo individualmente para emitir la sentencia y la probable compensación...

La Iatrogenia es aquel daño que el enfermo no tenía y que tiene por causa el propio médico, o en un sentido más amplio, el que se deriva de la atención médica. Puede ser psicológica, cuando daña la integridad psíquica del individuo y sus principios ético-morales, que incluso pueden repercutir en agravamiento de enfermedades orgánicas; y puede ser no psicológica, cuando daña la integridad física del individuo. Por los problemas que aun se observan con estos fenómenos tenemos como objetivos: Reconocer el concepto, la etiología y las consecuencias de la Iatrogenia. Relacionar el condicionamiento social de este fenómeno tan frecuente e importante y el desarrollo de la Medicina como Ciencia que se ocupa del problema. Caracterizar éticamente cual debe ser el manejo del problema para su profilaxis con la comprensión científica de sus orígenes y consecuencias.Procedimiento: Se realiza un trabajo investigativo de revisión con el método de la lectura de documentos bibliográficos y el estudio comparado.Concluimos que: La Iatrogenia tiene infinidad de facetas, formas de aparición, que deben ser vigiladas y juzgadas siempre que sea preciso. Que es indispensable la formación integral desde el punto de vista ético y moral en el personal de la salud que además debe tener condiciones humanas especiales. Que el desarrollo Tecnológico y Científico tiene que ir aparejado por la concientización de los trabajadores que en ella se desarrollan para alcanzar las expectativas de la nueva Sociedad(AU)
It is an injury that did not exist before on the patients health and in the present the patient suffers it due to an ineffective medical care or to a doctors action, attitude or measure. This injury can be psychological when it attempts against the psychic integrity of the individual and his/ her moral and ethics concepts. It can become the organic diseases worse; and it is not psychological when it affects the physical integrity of the individual. Because of the problems observed, we have as objectives: to recognize the concept, the etiology and the consequences of the iatrogenic aspects; to relate the social conditioning of this frequent and important phenomenon and the development of Medicine as the science that deals with this problem; to characterize ethically which should be the management of the problem for its prophylaxis with the scientific comprehension of its base and consequences.Procedures: A research work is carried out with the revision of reading method on bibliographic documents and the compared studied.Conclusions: Iatrogenic causes have infinite sides and show up forms that must keep watched and be judge always provided if it is necessary. It is essential the integral education related to the ethical and moral point of view of the personnel that work at the Health System that must be characterized for having special human characteristics. The technological and scientific development must go on in the same direction of the workers consciousness in order to reach the new expectations of the society(AU)

En estudios realizados en la Biblioteca de la Facultad de Ciencias Médicas Dr. Enrique Cabrera, en el período de octubre-enero, nos percatamos de la escasez de bibliografía de las enfermedades iatrogénicas y mala praxis, lo cual motivó una investigación retrospectiva, recuperando, en las Bases de Datos LILACS, desde 1982 hasta la fecha y Medline de 1967 a la actualidad, un listado bibliográfico sobre estas enfermedades, y se obtuvo un total de 112 documentos como fuente de información para mejorar el servicio a los usuarios del lugar. Una vez recuperada ésta se procesan las temáticas tratadas y se analizan los resultados en cuanto a productividad de las publicaciones en años, revistas de mayor impacto, etcétera. Con el objetivo de ofrecer a los investigadores, profesores y estudiantes una bibliografía de estas dos temáticas médicas como importante herramienta auxiliar que les permita llegar a sus documentos originales(AU)
According to studies carried out in the Library of the Faculty of Medical Sciences Dr. Enrique Cabrera, in the period of October - January, it was shown the shortage of bibliography of the keywords: diseases iatrogenic and mal practice, which motivated an retrospective investigation, recovering in the databases LILACS since 1982 to date and Medline from 1967 to the present time a bibliographical listing on iatrogenic diseases and mal practice respectively, Where there was obtained a total of 112 documents as source of information to improve the service to the users of the place. Once it recovered this the treated subject matter are processed, being obtained diverse results as for productivity of the publications in years, magazines of greater impact, etc. With the objective to offer to the investigators, professors and students a bibliography of these two medical as important subject matter tool to help that permit to arrive at its original documents(AU)

En noviembre de 1986 se iniciaron las Jornadas de Medicina Legal, gracias al apoyo del Dr. Eduardo Vargas Alvarado y del Dr. Fernando Garzona Messeguer y por supuesto el empeño y empuje de Doña Felicia Montealegre, secretaria del Departamento de Medicina Legal. Desde su inicio la actividad lleno las espectativas de los organizadores y los participantes. En 1993 se hizo un alto, en 1994 el Dr. Jorge Mario Roldán Retana les imprime un nuevo aire. Este segundo aire hoy nos hace sentirnos orgullosos al cumplir quince años de Jornadas.
In november 1986, we started with the Seminary of Legal Medicine, with the support of the Doctors Eduardo Vargas Alvarado and Fernando Garzona Messeguer, also with the support of Mrs. Felicia Montealegre, secretary of the Legal Medicine Department. Since the beginning this activity filled the expectations of the organizers and participants. In 1993 we had a brief stop, in 1994 Doctor Jorge Mario Roldan Retana gave to this activity a new vision. This second chance makes us happy and proud today, as we reach 15 years of annual Seminars.
