Interlocuções necessárias entre moralidade administrativa e probidade administrativa / Necessary dialogues between administrative morality and administrative probity

O presente artigo tem por escopo analisar as tensas relações entre moral, Direito e Estado, - adotando especialmente uma perspectiva habermasiana – a fim de verificar a estrutura e o papel da Administração Pública. Isto é, a administração não pode agir em interesse próprio, devendo sempre seguir as diretrizes determinadas pela Constituição Federal e legislação. Foi tratada também a discussão existente sobre moralidade e probidade administrativa, principalmente no que tange a corrupção. É preciso encontrar um conceito pontual de moralidade para analisar a efetivação do dever de boa administração, pois a moralidade administrativa tornou-se um direito público do cidadão. Em muitos julgados é notável a má gestão pública, e muitas vezes é afastada a punição por não enquadramento em improbidade. Pelas razões expostas no trabalho, entende-se que esta situação precisa ser alterada.

This article has as in its scope analyze the strained relations between morality, Law and State, - adopting especially a Habermas perspective – in order to check the structure and role of the Public Administration. This means that the administration can’t act in their own interests, must always follow the guidelines set by the Federal Constitution and legislation. Has been addressed the existing discussion about morality and probity administrative, principally with regard to corruption. It must be found a specific concept of morality to analyze the realization of the duty of sound administration, because the administrative morality has become a public civil right. In a large body of case law is remarkable the low quality of public management, and many times is squashed the punishment for not framework in improbity. For the reasons explained in the work, is understood that this situation needs to be changed.
