RESUMO

The use of artificial intelligence (AI) to aid legal decision making has become prominent. This paper investigates the use of AI in a critical issue in employment law, the determination of a worker's status-employee vs. independent contractor-in two common law countries (the U.S. and Canada). This legal question has been a contentious labor issue insofar as independent contractors are not eligible for the same benefits as employees. It has become an important societal issue due to the ubiquity of the gig economy and the recent disruptions in employment arrangements. To address this problem, we collected, annotated, and structured the data for all Canadian and Californian court cases related to this legal question between 2002 and 2021, resulting in 538 Canadian cases and 217 U.S. cases. In contrast to legal literature focusing on complex and correlated characteristics of the employment relationship, our statistical analyses of the data show very strong correlations between the worker's status and a small subset of quantifiable characteristics of the employment relationship. In fact, despite the variety of situations in the case law, we show that simple, off-the-shelf AI models classify the cases with an out-of-sample accuracy of more than 90%. Interestingly, the analysis of misclassified cases reveals consistent misclassification patterns by most algorithms. Legal analyses of these cases led us to identify how equity is ensured by judges in ambiguous situations. Finally, our findings have practical implications for access to legal advice and justice. We deployed our AI model via the open-access platform, https://MyOpenCourt.org/, to help users answer employment legal questions. This platform has already assisted many Canadian users, and we hope it will help democratize access to legal advice to large crowds.

Provider network structure has been linked to hospital cost, utilization, and to a lesser degree quality, outcomes; however, it remains unknown whether these relationships are heterogeneous across different acute care hospital characteristics and US states. The objective of this study is to evaluate whether there are heterogeneous relationships between hospital provider network structure and hospital outcomes (cost efficiency and quality); and to assess the sources of measured heterogeneous effects. We use recent causal random forest techniques to estimate (hospital specific) heterogeneous treatment effects between hospitals' provider network structures and their performance (across cost efficiency and quality). Using Medicare cost report, hospital quality and provider patient sharing data, we study a population of 3061 acute care hospitals in 2016. Our results show that provider networks are significantly associated with costs efficiency (P < .001 for 7/8 network measures), patient rating of their care (P < .1 in 5/8 network measures), heart failure readmissions (P < .01 for 3/8 network measures), and mortality rates (P < .02 in 5/8 cases). We find that fragmented provider structures are associated with higher costs efficiency and patient satisfaction, but also with higher heart failure readmission and mortality rates. These effects are further found to vary systematically with hospital characteristics such as capacity, case mix, ownership, and teaching status. This study used an observational design. In summary, we find that hospital treatment responses to different network structures vary systematically with hospital characteristics..

With the increase in massive digitized datasets of cultural artefacts, social and cultural scientists have an unprecedented opportunity for the discovery and expansion of cultural theory. The WikiArt dataset is one such example, with over 250,000 high quality images of historically significant artworks by over 3000 artists, ranging from the 15th century to the present day; it is a rich source for the potential mining of patterns and differences among artists, genres, and styles. However, such datasets are often difficult to analyse and use for answering complex questions of cultural evolution and divergence because of their raw formats as image files, which are represented as multi-dimensional tensors/matrices. Recent developments in machine learning, multi-modal data analysis and image processing, however, open the door for us to create representations of images that extract important, domain-specific features from images. Art historians have long emphasised the importance of art style, and the colors used in art, as ways to characterise and retrieve art across genre, style, and artist. In this paper, we release a massive vector-based dataset of paintings (WikiArtVectors), with style representations and color distributions, which provides cultural and social scientists with a framework and database to explore relationships across these two vital dimensions. We use state-of-the-art deep learning and human perceptual color distributions to extract the representations for each painting, and aggregate them across artist, style, and genre. These vector representations and distributions can then be used in tandem with information-theoretic and distance metrics to identify large-scale patterns across art style, genre, and artist. We demonstrate the consistency of these vectors, and provide early explorations, while detailing future work and directions. All of our data and code is publicly available on GitHub.

Throughout the Holocene, societies developed additional layers of administration and more information-rich instruments for managing and recording transactions and events as they grew in population and territory. Yet, while such increases seem inevitable, they are not. Here we use the Seshat database to investigate the development of hundreds of polities, from multiple continents, over thousands of years. We find that sociopolitical development is dominated first by growth in polity scale, then by improvements in information processing and economic systems, and then by further increases in scale. We thus define a Scale Threshold for societies, beyond which growth in information processing becomes paramount, and an Information Threshold, which once crossed facilitates additional growth in scale. Polities diverge in socio-political features below the Information Threshold, but reconverge beyond it. We suggest an explanation for the evolutionary divergence between Old and New World polities based on phased growth in scale and information processing. We also suggest a mechanism to help explain social collapses with no evident external causes.

Group cooperation is fundamental to human society. The public goods game is often used to describe the difficulty of group cooperation. However, there are other structures of institutions to maintain group cooperation such as Rotating savings and credit associations (ROSCAs). ROSCAs are informal financial institutions that exist worldwide, in which all participants contribute to a common fund and take turns to receive a return. ROSCAs are common in developing countries and among migrant groups in developed countries. There are various types of ROSCAs, and they share a crucial problem in that participants whose turn to receive a return has passed have an incentive to default on their contributions. We conducted a laboratory experiment to investigate the mechanisms that can prevent default in a fixed ROSCA, in which the order of receipt of returns is determined before starting and is also known to members. The findings are as follows. (i) Excluding low contributors from ROSCA groups by voting increased contribution rates both before and after the receipt of returns. (ii) ROSCA members exhibited reciprocity and a sense of revenge: that is, members contributed to the returns payments of other members who had contributed to them, and did not contribute to the returns payments of non-contributors. Voluntary behaviors thus sustained ROSCAs. Meanwhile, an exogenous punishment whereby subjects were prevented from receiving returns payments unless they had themselves contributed previously did not increase contribution rates.

Whether costly punishment encourages cooperation is one of the principal questions in studies on the evolution of cooperation and social sciences. In society, punishment helps deter people from flouting rules in institutions. Specifically, graduated punishment is a design principle for long-enduring common-pool resource institutions. In this study, we investigate whether graduated punishment can promote a higher cooperation level when each individual plays the public goods game and has the opportunity to punish others whose cooperation levels fall below the punisher's threshold. We then examine how spatial structure affects evolutionary dynamics when each individual dies inversely proportional to the game score resulting from the social interaction and another player is randomly chosen from the population to produce offspring to fill the empty site created after a player's death. Our evolutionary simulation outcomes demonstrate that stricter punishment promotes increased cooperation more than graduated punishment in a spatially structured population, whereas graduated punishment increases cooperation more than strict punishment when players interact with randomly chosen opponents from the population. The mathematical analysis also supports the results.
