RESUMO

Academic scientists are increasingly engaged in translational research oriented toward bringing products and processes to commercial markets. They need to diligently analyze the intellectual property (IP) rights of others to avoid infringement, and use their own IP strategically. For this it is useful to perform a freedom-to-operate (FTO) analysis which includes searching the prior art and patent databases. This chapter outlines the principles of FTO analysis with a special focus on plant biotechnology.

RESUMO

The aim of this chapter is to provide some key information on patents and the patent system to assist someone embarking on the design, development, and commercialization of new antisense drugs.Here I outline certain key topics such as what is a patent ? why patent ? how do I protect my molecule with a patent ? confidentiality, searching for the same or similar molecules in the prior art, data requirements, the patenting timeline and freedom to operate.

Objetivo: proponer un procedimiento metodológico para la realización de búsquedas de libertad de acción utilizando información técnica legal de documentos de patentes. Métodos: primeramente se caracterizaron numerosas bases de datos de patentes de acceso gratuito disponibles en internet (Patentescope®, Latipat, Espacenet, Invenes, Depatisnet, Lens.org y Patentinspiration) con respecto a la cobertura temporal y a la cantidad de patentes cubanas, y se identificaron y estudiaron dos fuentes de información que recogen estados legales de estas (INPADOC y WIPO Register Portal). Resultados: Patentscope® e Invenes se consideraron como las mejores bases, ya que permiten la búsqueda en el documento completo (título, resumen, descripción y reivindicaciones) mediante palabras clave; y Depatisnet se considera útil cuando se consulta mediante el Código Internacional de Patentes reclasificado por la Oficina de Patentes Alemana. No obstante, se recomienda el uso de todas las bases estudiadas para evadir errores relacionados con los contenidos y otras limitaciones relacionadas con las facilidades de búsqueda. A partir de las prestaciones detectadas en las fuentes de información analizadas, se implementó y perfeccionó un proceso de búsqueda sobre un medicamento preventivo contra el VIH/SIDA que demostró que existía libertad de acción en Cuba para su explotación, así como también la pertinencia de las herramientas y la metodología utilizadas para realizar este tipo de búsquedas. Conclusiones: este estudio de caso permite poner en práctica un procedimiento para realizar búsquedas y evidencia la importancia de la implementación del servicio de búsqueda libertad de acción para facilitar el acceso a invenciones patentadas, especialmente en el campo médico-farmacéutico(AU)


Objective: a methodological procedure is proposed to conduct freedom-to-operate searches using patent documentation-related legal technical information. Methods: first, characterization was performed of a large number of open-access patent databases available on the Internet (Patentescope®, Latipat, Espacenet, Invenes, Depatisnet, Lens.org and Patentinspiration) with respect to time coverage and number of Cuban patents, followed by identification and analysis of two information sources referring to their legal status (INPADOC y WIPO Register Portal). Results: Patentscope® and Invenes were considered to be the best databases, since they allow to search the entire document (title, abstract, description and claims) by means of key words. Depatisnet was found to be useful for inquiries about the International Patent Classification as re-classified by the German Patent Office. However, it is recommended to use all the databases studied to avoid content-related errors and other limitations to do with search functions. Based on the possibilities offered by the information sources analyzed, a search procedure for an HIV/AIDS preventive drug was implemented and perfected, showing that there was freedom-to-operate in Cuba for its exploitation, as well as the relevance of the tools and the methodology used to perform this type of search. Conclusions: in this case study a procedure is made operational and evidence is provided of the importance of implementing the freedom-to-operate search service to facilitate access to patented inventions, especially in the medical-pharmaceutical field(AU)

La tolerancia a herbicidas es una de las características más usadas en los cultivos GM, con resultados positivos para los agricultores y el ambiente. El punto de partida, es el desarrollo de casetes de expresión que expresen la característica de interés, inicialmente construidos mediante técnicas de biología molecular convencionales. Actualmente, con herramientas de bioinformática y biología sintética, es posible diseñar y probar el constructo in silico, para luego contratar su síntesis. Esta aproximación, permite optimizar la expresión mediante la modificación del uso codónico. En este trabajo se diseñaron y evaluaron en Nicotiana benthamiana versiones semisintéticas de genes que confieren tolerancia al herbicida fosfinotricina. Se realizó un análisis de libertad de operación, con el fin de asegurar que los constructos diseñados no violen derechos de propiedad intelectual en Colombia. Se obtuvieron dos casetes de expresión con libertad de operación, que expresan versiones del gen bar.


Herbicide tolerance is one of the features most used in GM crops, which has shown positive results for farmers and the environment. The starting point is the development of expression cassettes that express the characteristic of interest, they are initially constructed by standard molecular biology techniques. Currently, by bioinformatics and synthetic biology tools, it is possible to design and test the construct in silico, and then hire their synthesis. This approach allows optimizing expression by modifying the codon usage. In this work there were designed and evaluated semi-synthetic versions of genes in Nicotiana benthamiana, these genes confer tolerance to the herbicide phosphinothricin. It was made an analysis of freedom to operate in order to ensure that the designed constructs not violate intellectual property in Colombia. There were obtained two expression cassettes with freedom to operate, which express versions of the bar gene.

RESUMO

Patentable inventions may be made during the development of a vaccine, and patents on such inventions can help to protect the vaccine from competition. This chapter introduces several patent law concepts, including patent eligible subject matter, written description, enablement, novelty, and nonobviousness, by following a hypothetical vaccine development timeline that begins with the discovery of a previously unknown virus and ends with the commercial launch of a vaccine against the virus. Regulatory exclusivity, freedom to operate, and lifecycle management considerations are also discussed.

Antibody-drug conjugates are highly complex entities that combine an antibody, a linker and a toxin. This complexity makes them demanding both technically and from a regulatory point of view, and difficult to deal with in their patent aspects. This article discusses different issues of patent protection and freedom to operate with regard to this promising new class of drugs.

RESUMO

The production of recombinant vaccines in plants may help to reduce the burden of veterinary diseases, which cause major economic losses and in some cases can affect human health. While there is abundant research in this area, a knowledge gap exists between the ability to create and evaluate plant-based products in the laboratory, and the ability to take these products on a path to commercialization. The current report, arising from a workshop sponsored by an Organisation for Economic Co-operation and Development (OECD) Co-operative Research Programme, addresses this gap by providing guidance in planning for the commercialization of plant-made vaccines for animal use. It includes relevant information on developing business plans, assessing market opportunities, manufacturing scale-up, financing, protecting and using intellectual property, and regulatory approval with a focus on Canadian regulations.

Patent activity in the field of medical device technology and especially in the area of artificial pancreas development has surged in recent years. According to the search presented in this article, the number of granted U.S. patents in the area of closed-loop glucose control (CLGC) increased from 24 filed in 1991 to 247 filed in 2001. A company active in the area of diabetes technology development will likely need to understand a patent landscape consisting of hundreds of patents. Currently, both in the United States and in Europe, patentability requirements seem to be raised in order to ensure patent quality. However, the current patent landscape reflects the work of the patent offices in the past, as already granted patents are not affected by changes made to the patent grant procedure today.Regarding the increasing amount of patents and considering the complexity of CLGC systems, the attempt to develop a CLGC system will become more and more venturesome regarding the risk of infringement of already existing patents. The consequence of this situation can be that less innovation takes place.This article highlights some important general aspects of the patent system, briefly characterizes the current CLGC patent landscape, and illustrates by means of two exemplary patents what one angle of said patent landscape looks like. It is our opinion that, in order to support the rapid development of an artificial pancreas for patients with diabetes, adequate action to lower this hurdle should be undertaken by a consortium of all parties involved (industries, patient organizations, health-care professionals, and institutional payers).
