Da ideologia da inovação à "inovação" da ideologia descolonizando o sistema que impõe as patentes de medicamento / From ideology of innovation to the "innovation" of ideology: decolonizing the system that imposes medicines patentes

RESUMO

As patentes de medicamentos se apresentam como uma grande barreira para o acesso da população, de acordo com a necessidade de saúde. Este trabalho parte do pressuposto de que, para pensar o acesso o medicamento é preciso avançar para além de um debate técnico, regulatório e legal; compreendendo a necessidade da retomada de um debate de cunho ideológico. Esta tese como propósito apresentar o conceito de ideologia no contexto dos medicamentos; no qual foi definido que essa se expressa na forma de inovação e patentes. Através da compreensão, construída neste trabalho, de Aparelho Ideológico de Mercado, foi realizada uma análise do Manual de Oslo e relatórios técnicos, que compõem um pedido de patente no Brasil. Foi identificado o papel da inovação, fortalecendo a lógica mercadológica, que impede o acesso e o desenvolvimento interno do setor farmacêutico no país, promovendo uma situação de dependência. Foi proposto um novo olhar a partir da Teoria da Dependência e do Pensamento Decolonial para sairmos da postura de subordinação e dependência imposta por um sistema produtivista, voltado exclusivamente ao lucro, que nos prejudica diariamente e nos mantem reféns do sistema capitalista

ABSTRACT

Patents in the pharmaceutical field usually represent a major barrier to the access of medicines according to the population health needs. This study assumes that the issue on access to medicines, should go beyond the usual technical, regulatory and legal debate, understanding however the immediate need of including a debate on ideology. This thesis aims to present the concept of ideology in the context of medicines; where it was defined that this is expressed in the form of innovation and patents. With the understanding of the Ideological Appliances of the Market, developed in this work, an analysis was made of the Oslo Manual and the technical reports, which make up a patent application in Brazil. This study has demonstrated the impressive role of innovation, which by one hand underlines the market´s logic and by another prevents the population access to medicines. This scenary hinders consequently the development of the national industry, fostering however dependency in this sector. It is proposed a new insight from the Theory of Dependence and the Decolonial Studies, in order to finally break down the posture of subordination and dependence imposed by this market, which is exclusively focused on profit and furthermore injures the people while holding them hostage to this capital system
