RESUMEN
El derecho es el elemento regulador de las relaciones sociales, entre las cuales figuran las generadas en el sector de la salud, tanto en las funciones de rehabilitación como preventivas, de promoción de salud e inspección sanitaria estatal; por ello la actuación médica, independientemente de su naturaleza, tipo, clase o forma constituye un acto médico, que puede ser correcto o lícito cuando se ejecuta según las disposiciones legales u oficiales vigentes e incorrecto o ilícito cuando no las cumple durante el ejercicio de su profesión. En este artículo se tratan, entre otros importantes aspectos, los relacionados con la Teoría general del derecho médico, el sistema jurídico cubano, la Constitución cubana y el derecho a la salud, el consentimiento informado y la norma jurídica del secreto médico(AU)
ABSTRACT
Right is the regulator element of social relations, among which there are those taking place in the health sector, either in the rehabilitation functions or preventive functions, health promotion and state sanitary supervision functions; that is why the medical role, independently of its nature, type, class or form constitutes a medical performance that can be correct or licit when it is carried out according to the present legal or official arrangements and can be incorrect or illicit when they are not fulfil during the practice of their profession. This article deals, among other important aspects, with those related to the General theory of the medical right, the Cuban legal system, the Cuban Constitution and the right to health, the informed consent and the legal regulation of the medical secret(AU)
