RESUMEN
Este trabajo analiza la reciente Sentencia de la Audiencia Nacional de 27 de enero de 2016, que desestima la demanda presentada contra el Ministerio del Interior y en la que se exigía una indemnización por la presunta desatención médica -de la que se culpaba a los servicios sanitarios penitenciarios-, que, según la parte demandante, fue causa de una necrosis isquémica distal y, en definitiva, de la amputación de los cuatro miembros de un interno. Al hilo de la resolución judicial, se examina someramente la responsabilidad patrimonial de la Administración por el funcionamiento de sus servicios sanitarios y el parámetro o criterio de la denominada lex artis ad hoc (reglas del oficio aplicadas al caso concreto), que actúa como instrumento para valorar lo adecuado de la prestación sanitaria y, a la postre, como medida correctora de la mera responsabilidad objetiva, que atiende únicamente a los daños o lesiones producidas (AU)
ABSTRACT
This study analyses the recent Sentence of the Spanish High Court of 27 January 2016, which dismissed the claim lodged against the Spanish Ministry of the Interior in which compensation was demanded for alleged medical negligence. According to the plaintiffs plea, said negligence by the prison health services had led to a distal ischemic necrosis and the subsequent amputation of the four extremities of a prison inmate. In view of the courts decision, a brief examination is made of the professional liability of the Administration with regard to the performance of its health care services and the parameters or criteria of the lex artis ad hoc (standard of conduct applied to a specific case), which acts as an instrument to assess what is adequate in health service provisions and, ultimately, as a corrective measure to mere objective responsibility, which only considers the damages or injuries caused (AU)
