RESUMEN

Las jornadas pretenden analizar la actuación de los profesionales sanitarios de emergencias en el entorno de situaciones con connotaciones médico legales que van desde el fallecimiento de la persona en una escena violenta hasta la actuación frente a pacientes agresivos o agitados. En toda situación con sospecha de violencia o posible delito queda clara la prioridad de las actuaciones sanitarias en el paciente vivo o la necesidad de confirmar la muerte. Se deben de evitar todos los gestos innecesarios, así como intentos de reubicar los objetos que se hayan podido mover. Es importante conocer los aspectos básicos de las investigaciones policiales para evitar que nuestra intervención pueda dificultar su labor. Ante un paciente agitado, lo prioritario son las medidas de seguridad, tanto de cuerpos de seguridad, como las medidas de seguridad pasiva. Procederemos inicialmente mediante la contención verbal; de no ser eficaz, se procederá a la contención física, con al menos 5 personas y a continuación el tratamiento médico. En estas situaciones el médico se convierte en autoridad. Muchas de estas situaciones requieren de internamiento involuntario urgente, regulado por ley y que permite a cualquier médico tomar esta decisión por razones médicas y posterior comunicación al juez. Es muy importante reflejar en la historia los motivos del ingreso o traslado, así como la medicación aplicada, para que los psiquiatras y forenses tomen las decisiones pertinentes respecto a la pertinencia o continuidad del ingreso. En todas estas situaciones, se maneja una información personal referida a datos de salud, los cuales son de alta protección y sometida a secreto profesional, propio, derivado o compartido. Este derecho a la intimidad protegido por el secreto profesional no debe comprometer el bienestar social. La historia clínica se convierte en herramienta fundamental para psiquiatras y médicos forenses. Es un documento de gran ayuda médico legal que protege al profesional en la justificación de la toma de decisiones(AU)

ABSTRACT

The conferences aim to analyze the performance of health professionals in emergency situations in the environment of legal medical aspects ranging the death of the person at the crime scene to act whit aggresive or agitated patients. In every situation whit suspected crime or violent situation, the priority is the health performance in the living patient or the need to confirm the death of the person. It should avoid any unnecessary acts like to relocate the things that may have been moved. It is important to know the basics aspects of police investigations to avoid that our intervention may hamper their work. The priority faced an agitated patient, are the security mesures, the agents of the authority and the passive safety mesures. Initially we will proceed throught the verbal restraint, in case it will be not effective, the next step it is the physical restraint, whit at least five people, and then, the drug treatment. In these situations the physician becomes the authority.Many of these situation require urgent involuntary interment in the hospital, governed by law, and that allows any physician to take this decision for medical reasons and subsequent communition to the judge. It is very important to write on the clinical report the reasons of the internment or the transport the patient to the hospital, and the medical treatment admistrated. For the pshiquiatrist and forensic workers it is very important this information in order to take decisions about the internment of the patient. In all these described situations, we manage personal information and health data, which are the higgest protection and summited to profesional secrecy, in it self, derived or shared. This right to the privacy protected by the professional secrecy should not can risk welfare. The medical report becomes a key tool for forensic doctors. It is a helpful document that provide to health workers legal protection in order to justify the making of decisions(AU)
